Dismissal Appeal! Help please.

    I did immediately refer the information constantly in fact for 13 weeks, requested updates and hounded my line manager for updates and questioned why nothing was happening. Are you seriously telling me that if a guy (bearing in mind I'm a young female) was threatening to kill himself you wouldn't get involved and try and help. Unless you're in that situation I don't believe you can say how you would act. I got involved because I was the person who was left alone pretty much every day with him and he put me in a compromising situation. Hindsight is a wonderful thing and I wish I had just told him i couldn't help, but having lost a partner to suicide I try and help anyone I can to guide them to a better place.

    I don't really care tbh if the information doesn't add up to an outsider. That wasn't the reason for the post. I was simply asking for advice on appeal process. I wasn't seeking people's opinion as to whether the facts of the matter are true on my part. It's against company policy to consult police prior to an internal investigation taking place. FYI, the support I was offering was over a short period as soon as the threats etc began I raised issues with management by way of grievance and as the OP stated I was left for 13 weeks extremely distressed and uncomfortable to work. It wasn't until I handed my official notice in did they take it seriously yet dismissed me anyway.

    Fair enough, OP though it is difficult to comprehend how you could be left alone with someone who had threatened violence towards you and himself with no comeback for your employer. What if he had carried out his threats? No doubt they would have ducked responsibility and claimed it was a personal thing.

    I knew our mental health and social care sectors were in a mess but this is hair-raising. Heaven help those vulnerable people this individual is supposed to be caring for.

    This is a discussion forum on which anybody can post. They are not restricted to answering your specific questions nor are they prohibited from expressing their opinions. Inevitably some of those opinions may not be what you want to hear.

    Speaking or which, I am surprised about your claim that "it is against company policy to consult the police"! If you believe a crime has been committed or indeed if you believe somebody's life to be in danger then surely it is your duty to inform the police? No company policy attempting to prevent that can be enforceable.

    Without knowing a great deal more about the whole setup and apparent problems it is difficult to offer much further help.

    As Crazy Jamie has pointed out it is far from certain that the OP has actually made a protected disclosure. Plus, even if they have, there is a lot of work to do to prove that was the real reason for their dismissal.

    With a union involved, hopefully at legal rather than lay level, all the OP can do is be guided by them. They at least (hopefully) have the full story.

    Name the council. I don’t believe that any council would have such a policy about the police.

    Lots of stuff doesn't add up here. We can't help if you we don't know the whole story. It's just wasting everyone's time.

    Just a quick message to close this thread down.

    I won my appeal on all 4 grounds and offered reinstatement however in the meantime found a better job and decided not to return due to mistrust issues.

    Union have negotiated a deal including back pay, compensation a good reference and a letter to my old team to advise I was exonerated. Good result all round!!

    For anyone who was doubting me, doubting my story over the last 3 month I have proved I was right on all accounts and very happy with the result!!
