If I'd had insurance, how could I have claimed anything since I did not pay for any of it?

I'm sorry to hear about your loss, it must be a very difficult time.

You can insure things you did not pay for. I have a distant relative who has stopped driving due to ill health. His daughter is using his car and has insured it in her name. She didn't pay for it, he retains ownership of it, but she insures it.

There are countless examples of why people might insure things they did not pay for.

Think of it as a gift from your mother. If you receive any expensive gift - car, jewellery, horse, sofa you may choose to insure it.

You're missing the point though. A family policy will not usually cover adult children only dependents. So your parents were covered, you weren't and your children were as they are dependents.

A general point, travel insurance covers more than just the cost of travel. Medical insurance is the obvious area, so irrespective of who paid for a holiday you should always take out insurance.

Doesn't matter who paid, your mother essentially gifted you the holiday. The same principle as if she gifted you a car or a mobile phone if you insure then you can claim for damages/loss.

I would count my lucky stars that M&S paid out for the kids, which are not the insured person adolescent children.

Chalk it down to experience and make sure that next time you have appropriate travel insurance for everyone or book flexible flights/accommodations.

Yes that's the policy but my argument is that she's paid for the whole holiday not me. If I had taken out insurance I couldn't claim as I didn't pay anything.

You'd have covered for any illness or injury you suffered on ho,iday, any lost property, any transport problem.

I am sorry for your loss. It's a hard time for you all.

I think the comparisons with gifts are good ones. Hopefully that'll help you to understand the situation.

To be honest I think it's good that the M&S policy covers your children at all. I wouldn't have been surprised if it just covered your parents as your children aren't dependent on them.

Of course, ask for an explanation, but I'd be surprised if you got any more reimbursement from M&S.

Would there not be a worry that if they press M and S too much they might look again at the claim and decide not to pay out on the OP s children ?

Ni, I checked and I think the cover is very generous IMO. It covers the card holder, spouse /partner and children travelling with them. The children can be their own grandchildren, great grandchildren, step or fostering. The children can travel with either adult but it's quite clear that children have to be under 18.

I can't really understand why OP thinks she'd be covered for cancellation but not health or belongings as she intended to take out a policy for that.
  • Sorry for your loss.

We've had to cancel due to a death (father in law) We lost out. Our policy covered myself, husband and son. Just OH and myself were going originally, and then son and friend decided to come very last minute so booked their flights separately. We paid for everything but had to cancel 2 days later. Got the money back for myself, husband and son, but not for sons friend because he was not covered on our policy.

You should have taken insurance out for yourself as soon as the holiday was booked.
