Travel insurance ... Please help!

My dad died recently and we had to cancel our holiday. My mum paid for the holiday for herself, my dad, me and my 3 children. Her M and S travel insurance through her credit card covers her and will pay out for her, my dad and my children but even though she paid for the holiday, they won't pay out for me. I did not pay for any of the holiday, she did but they say that I am not covered. She is now out of pocket as she paid for us all. Is this right?

    Have they said why?

If the policy only covered some then the other should have sought insurance.

Probably best on either the insurance or holiday forum

Just get your mother and yourself to drop into your nearest CAB Citizens Advice Bureau with all your paperwork and they will assist you for free. No need to make an appointment.
There will be an explanation somewhere within the paperwork that will show that either your mother or M&S are right.

They said that it only covers her, my dad and my children. They said that I would need to claim off my insurance but I did not pay for any of the holiday. I also did not take out insurance as I take it out before the holiday to cover accident/sickness. I didn't think I'd need it to cover the holiday as I didn't pay for it

What do the terms and conditions on your mother's travel insurance actually say? Is it free cover that came with the card - if so, she should have a booklet somewhere. It would be unusual for it to cover 6 people though. without extra add-ons.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

Probably the reason they won't pay out is that family policies usually only cover a maximum of 2 adults plus up to 5 or 6 kids.
We had to take a second policy for my eldest dd as she is now an adult.
For future trips, make sure you take out insurance as soon as you book your holiday so that you will be covered.

I'm sorry for your loss. It is never an easy time. Thankfully at least the rest of the family were covered or you would have lost all of the money.

Does she have M&S Premium Club + Travel Insurance (£25 pa)?

If so, Rosie appears to be right. The policy says:

You will also be covered if your travelling companion has to cancel the trip or come home early for one of the reasons listed above
note 'travel companion' singular - in this case that would be your dad. I've not read the entire booklet but assume children are covered too.

Yes that's the policy but my argument is that she's paid for the whole holiday not me. If I had taken out insurance I couldn't claim as I didn't pay anything.

You can argue as much as you want.

But if the policy covers the 'insured person' plus 'travelling companion' and no one else, they will not cover multiple companions!

Most insurance like that covers both adults plus children.

You are an adult - you should have had your own insurance. It doesn't matter who pays.

She could pay for the entire plane - 200 people - and then lose her husband and claim for all 200............ clearly that doesn't work

So the rules are that it is her, and one adult travelling with her, plus any dependent children.

    Who paid is irrelevant.

Sorry - but insurance is always structured in a certain way and saying i didn't know or I would have taken out insurance doesn't offer you cover.
