Hi all, ive received a Notice of Proposed Allocation to the small claims track - not sure what i am supposed to be doing with it - its saying to complete the small claims questionnaire and file it with the court office and serve copies on all other parties? This is due by 8 Oct? Can I do this online? Do i go for mediation?
I never knew this was going to be as bad as this, life is !!!! as it is let alone with things like this that I just don't understand.
Please help if you can0 -
All explained, step by step (every step of the way) in the NEWBIES FAQ sticky, post #2, all your questions above answered. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Firstly, mediation is a very bad idea pointing to you losing
You said you are scared, but given the way the courts are now handling Abuse Of Process cases, rest assured the claimant is also scared because they will never know when and where they will be spanked again
As said follow the NEWBIES FAQ sticky, post #20 -
have you had chance to look at what the court sesion will be like ?
if not then....
Have a look at this short video:

Point 8 in the list in post #12 above warned you to expect that.
Read Bargepole's 'what happens when' post linked from post #2 of the NEWBIES thread to find out exactly how to answer every question on that form.0 -
I agree with the above , especially KeithP who told you about this next stage in his advice post , never mind that bargepole posted about it 3 or 4 years ago and it's linked in post #2 of the Newbies FAQ sticky thread near the top of the forum

This is still going on and I have today received a form from the court saying the judge has considered the staements of the case and directions questionnaire filed and allocated the claim to the small claims track. It then goes on to say unless by 4pm on 14 Jan I pay a trial fee of £25 or file a properly completed applicaton the claim will be struck out with effect from 14 Jan.
What does this mean? Does anyone know or can help me. I keep looking through 'sticky threads' for answers but I keep getting lost around the forum.
What a great start to the new year.0 -
I doubt that it says you should pay any fee
It is the claimant that pays the court fee , not the defendant
It is also the claimant that fills in a properly worded claim form too
Read it again , properly0 -
Thank you RedX, it does say claimant. I don't understand any legal documents and when this came through the door I immediately panicked and thought they were saying I needed to pay.
Thank you for pointing that out, my heart has calmed down a bit now.
So I take it i am now playing a waiting game to see if the civil enforcement ltd reply otherwise I attend court in February?0 -
