claim form from court and Im scared now

Options
Hello, before i begin please understand i have dyslexia and suffer from anxiety and depression.
I was doing a few hours voluntary work at a charity shop on a saturday which is next to a co op and i got a ticket sent through the post, the lady in the shop could not get onto the website

to put my car registration details in as she did not have the passwords and the manager was off - the parking people had only just started this parking ticket thing because it used to be a completely free car park, i looked on the martin money page and it said not to pay it so i didn't and lots more letters come through to me and the fine has gone up more. now i have got a claim form, i was reading the forum and now spent nearly 2 hours on the computer on goverment gateway setting up an account and then putting in my claim number and password details and after reading the forum it said to just say i am defending all of it, so i ticked that box.
now the forum is saying to start a defensive - i keep reading lots of things and i don't understand what to do, i am scared now that i dont know what to do, i will have to pay and it has gone up to £196.16. I do not do the work at charity shop as i could not carry on anymore and i am worried i will get another ticket. The manager lady in the shop was not helpful, she said i should appeal it and i did with popla but they said no which is why i now have the claim form. I do not feel happy to be at court because they may make me say things that i dont want to say and it would be my fault. Please help me to understand what I am to do. Thank you, i told my mum who is not happy i now have a claim form but she is worried people will knock on door and take stuff from the house. Its all got to a mess and i was only helping in the shop to try and get my confidence up. Thank You, Mog

What is the Issue Date on your Claim Form?

Did it come from the County Court Business Centre in Northampton, or from somewhere else?

Sounds like you need to copy another defence from here, one of loads we have seen about new restrictions where the car park was previously unenforced.

But you need to answer the basic 3 questions above, first please.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • the claim came from northampton, it was from the county court business centre, 4th floor st katharines house. the parking company claimant is civil enforcement limited, horton house, liverpool.
the issue date on the claim form is 17 july 2019. i have been on the government website and made an account and then found this claim website MCOL and ticked one box saying i will defend it. it then said the acknowledgement of service was on 30 july 2019. the price has now gone up to £271.16.
when i was reading the notes in the beginners info a lot of it really does not make alot of sense to me, i am struggling what i need to do now as i cannot afford to get a solicitor - all i did was go to help in a charity shop and now this has happened, lots of the customers in the shop said they had got tickets too but they were scared so they paid them.
  • yes it came from county court business centre, northampton. thank you for trying to help me
  • the parking company are called civil enforcement ltd and they are in liverpool - does that help?

the parking company claimant is civil enforcement limited,
So now search the forum. My suggested keywords for 3 searches to start you off, are:

    Civil defence true new restrictions

    Civil defence true temporary signs

    defence hidden keypad

Always change the ADVANCED search to SHOW RESULTS AS POSTS.

the price has now gone up to £271.16.

No-one will call at your house but you might get lots of scary letters threatening penury and starvation and lots of stuff in red ink from debt collectors. You may even get phone calls from down market law firms.

This can be quite complicated with lots of stuff to read so you might consider getting help as the parking companies are merciless, greedy, and dishonest.

They are asking much much more than the law allows, which may be an abuse of the legal system.

Can you not get a senior manager in the charity you work for to help?.
Better still, get your MP involved as nine times out of ten these tickets are scams.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
You never know how far you can go until you go too far.

No one is going to turn up to "take stuff" unexpectedly!

Tell your Mum not to be worried about that!

To get a bailiff the claimant would first have to win in court, then the defendant ignore the order to pay (ccj)

The claimant could then apply for enforcement order, but you would know about that if an application was made.

So now concentrate on dealing with the claim.

Your first job is to complete the AOS (all explained in the FAQ) which will buy you an extra 14 days to get your defence in

OP's done that, and on my calculations has until 19 August to defend (don't leave it till the last minute though)
