thank you, you are so helpful.

i am unsure of exactly what i am applying for?

i don't understand what a draft of the order means. i know i don't have one so do i need to get one together?

i have been dealing with a judge and a district judge so far so i'm guessing that either one of those would be appropriate to choose to deal with the claim.

also guessing that the judge who was going to be at the hearing on friday should be served the order.

should i set out the evidence in the box on the form and signpost to my WS too. does my WS say enough? should i send more evidence about my health?

You're applying for a costs hearing!
    You know this
Youre applying to convert the hearing, paid for by the Claimant, into a costs hearing to discuss the substantial unreaosnable behaviour on their part, and yoru claim under CPR27.14(2)(g) for your full costs.

You could include a draft order - again, you can find this out elsewhere. An Order is what the court makes to the parties involved in a claim, and in this case you want the court to Order that the hearing of X date is vacated and is listed again for xx.yy.2020 as a hearing to determine the defendants costs of the claim. Or something along those lines. But it is so simple an Order dont panic if you dont write one.
(Look back at the hearing date letter - you will see it is the court Ordering)
I would use the judge that was listed for your claim
Set out what evidence? Youre not making out your costs claim in this Application, thats for the hearing. But of course you would wantto bullet point enough.

  • finally found this thread again through an email seach. i have my day in court today, well via telephone anyway and i know it's a bit last minute but i am hoping to get some support and/or encouragement. i am apprehensive about what the judge might ask me and i hope i will be convincing enough with the little knowledge i have to help my case. any advice will be greatly appreciated. thanks

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Remind us of your arguments about injury to feelings.  Do you understand the law about damages for distress and know what to say?
