the judge has replied... he has advised me to fill in a N244 form. “Since this is a Small Claim only fixed costs are payable unless an exception applies. A formal application will be required.“
can someone please tell me if i fill it out as a new case or am i still the Defendant?0 -

How could it be a new claim? Youre looking for costs due to the claim. You havent filed a claim. so it cant be a new claim.3 -

You realise a N244 requires a fee? its a formal application.
I doubt it would go ahead/. Think how quickly you are expecting a juge to get the form and review it and make a determination and tell all parties...1 -
Do you qualify for help with court fees? If so then fill in that form and the 'help with fees' form and send it in!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
