County Court Defence Help Please
Comments
-
There are links to loads in the Newbies thread. You are probably looking for something specific to your case. Don't. Look for a general CEL defence.
The specifics of your case are now irrelevant. You need to look for issues around signage, none compliance with POFA and failure to make reasonable adjustments for your disability.
You should search for the Equality Act too.0 -

That's a POFA failure you need to look for. Plenty of those around. They can chase the registered keeper as long as they stick to the strict requirements laid out in POFA.
Check your paperwork for failures in the wording.0 -
so after doing a lot of reading, i have decided to go for a subject access request as i cannot find the paperwork and i feel i need to be armed with more knowledge before i can take them on. i do not know if i can use pofa as my defence as i do not know when the pcn arrived in the post.
can someone please tell me if the claim will be automatically delayed if they don't get the sar to me on time or do i need to let the court know what i am doing?? thank you0 -
The claim process won't be delayed
Don't miss the deadline for submitting your defence0 -

okay so the defence due date does not change regardless of when you submit the AOS? you must remember that you guys are the brains and we are just starting out.....i cannot find CEL's email address. i have searched google and can only come up with an appeals email. i obviously want to make sure the SAR gets to the correct person, any ideas please? also, i thought i read somewhere that i can call them to ask for the SAR, is that correct? i do really appreciate the help i am getting here and i hope it will help others to find the confidence to stand up to these crooks.....0

dataprotectionofficer@ce-service.co.uk.
dataprotectionofficer@PPC*.co.uk or
dpo@PPC.co.uk
*Obviously these need the PPC bit replaced by the proper name of the parking company.0 -
i thought i'd make an attempt to ask the landowner of butterfly walk to help me. they are mumbo jumbo world in soho and their front of house telephonist palmed me off with a telephone number for abc parking solutions. this sounded like another dodgy firm who i am guessing may have taken over the management of the car park from CEL. when i called i was greeted with a grumpy ello, (no company name) when i asked who i was speaking to, he answered George lolol, i explained that i wanted to speak to someone at abc solutions and he asked me to leave my name and number and someone would get back to me, likely story i thought but you never know. i called mumbo jumbo again to see if i could appeal to someone's better nature but i could not get past the front of house lady and she refused to give any information as to who would be best to contact to ask for help with the matter. unfortunately she did not have a better nature herself
guess that's why they employ her. she did tell me that she receives many calls about butterfly walk car park and she has been instructed to give this information and nothing else. i have the email addresses of eight employees including the CEO so i am going to draught a polite letter to all of them asking for their help hahaha
