  • stopping and parking are they one and the same when it comes to a pcn
    i'm wanting to add to my appeal no contract offered none breached
    but it does state on signs and the pcn the charge is for no stopping
    and not no parking so want to clarify this point i you can please

  • The sign is the contract, so it makes sense to put an image/the wording on the forum if you want anyone to guide you with your arguments.

    ok guys links to pics of signs and the actual pcn sent any input would be welcome
  • Yeah, good luck with enforcing that... It needs to be argued carefully, but the points that I'd raise if it were me (and it's not, so make up your own mind) are:

    1. how are you going to read that from a moving car (you'd surely have to stop to read it)

    2. If the road markings were double yellows, I think you'll find the highway code permits stopping on double yellows - what sign/making has precedence (needs to be double red for a clearway)

    3. Isn't it actually seeking to impose a fine for trespass, rather than simply apply any kind of contractual charge? How can that be an agreement - what benefit have you derived? If they sue under contract, it'll be hard, I think. If they sue under trespass, they definitely need to know the driver and (amusingly) it is a claim only available to the land owner.
