Help with backdating SDP of an old closed ESA claim!

    Is it possible to claim even though you did not claim for yourself beforehand.

    You'll just need to wait for DWP to make a decision on that claim, this can take a few weeks, maybe longer in your case because it was a previous benefit claim.


    Once a decision is made they'll write to you.

    Yea I did earlier on reply and said thank you I guess you answered my first question which I did/do appreciate. I was just trying to point out its fine I can be patient as someone said earlier anything I get will be great which I most definately am appreciative of.

    was just curious if there was any rules against claiming on an old closed esa claim and because I didn't apply myself (because I didn't know about the benefit until not that long ago).

    Hi Poppy,


    Had a missed call this morning from ESA funnily enough, I called them back they told me they calculated arrears of £7500 and will be in my bank by thursday. So quicker then 6 days even what a good result!
    I now wonder because of the SDP eligibility I had when I was on ESA if it affects my UC with the new SDP change.

    It is likely that in due course your UC entitlement will be increased to include an SDP loss compensation element (called a transitional element) and a compensation payment for the period from when you switched over. I have no idea what the timescales or mechanics for this to happen are.

    The transition element monthly amounts are

    (1) Single claimant and limited capability for work-related activity (LCWRA) element is included in the award £120
    (2) Single claimant and LCWRA element is not included in the award £285
    (3) Joint claimants where an SDP was payable in respect of both members and no person has since become a carer for either of them £405
    (4) Joint claimants where (3) does not apply and the LCWRA element is included in the award in respect of either of them £120
    (5) Joint claimants where (3) does not apply and the LCWRA element is not included in the award in respect of either of them £285

    Once you have written confirmation from DWP of SDP entitlement up to date of UC claim I suggest posting a note in your UC journal to bring potential entitlement to transitional payment/element to notice of UC.
