Delivery driver exceeding PE max stay for free

Hello ladies and gents,

I'm a delivery driver for amazon. One of my deliveries were in PE managed space, where i had multiple deliveries to different offices on the same site which it took me about half hour (rainy day, i did wait a bit in my vehicle to avoid getting soaked).
Obviously the PE letter came through post in no time and i genuinely appealed it because i was working on site (one of their offered reasons for appeals). The !!!!!s denied my appeal saying "Our records confirm that no parking was purchased on the date of the parking event, despite there being payment methods available on the day in question."
I reckon there was a 15 minutes free period i didn't notice their signs due to rain.

Do i have any grounds to make a successful appeal to popla for my genuine reason being at work?
Their parking charge of £100 is a rip off. I'm only paid half of that amount for my 4 hours work :mad: :slap:

    You cannot object to the £100 due to Beavis, that is the daily default tariff and has been so for a decade, irrespective of your daily wages

    A landowner complaint is your best option for cancellation, otherwise it could be the Jopson case

    IMO, PE signs leave much to be desired. I doubt that many judges would agree that they are capable of forming a contract, read this

    and enlist the support of your MP as they are obviously trying to scam you.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    The landowner is ABP (Associated British Ports)(town quay Southampton). I have found some nice appeal won at popla against PE last year in May for a similar stay of 31 minute. Ours was 35 minutes.
    I'm looking now for some templates to make my own complaint to BPA maybe i can persuade them to cancel it.

    See if byelaws apply as this would make the car park non-relevant land.


    Also look up the Laura Jopson vs Homeguard Services case as mentioned by Redx. The judge basically stated that loading/unloading (delivering) is not parking.

    Plus complain to all the companies to whom you made deliveries, and to the managing agent of the shopping centre and write bad stuff on their webpage and Facebook page. Kick @rse and cost the money.

    My popla appeal was unsuccessful... what's the next step? Popla assessor adviced to contact citizens advice...

    We appealed (is not my on my name, I'm a friend only) on ground there are no provisions for delivery signs or marks or marks to regulate loading/unloading therefore the parking notice was issued incorrectly because we did not park in site. However the assessor thinks he only has to decide of the pcn was correctly issued according to parking conditions and they simply dismissed all other motives...

    Part of answer: 'POPLA’s role is to decide if a PCN was issued correctly by the parking operator, as per the advertised terms and conditions of the site in question. I understand the appellant has shown they were on site for genuine reasons and I recognise their evidence in this regard. The appellant has made reference to another case to support their point that they were not technically parked this day.'

    Where am i going next? I'm not paying them £100 for working on site

    Stick with getting advice from people on this forum

    CAB will not be able to give you the detailed advice and support that you will get here as long as you listen to what folks say! Nor will they have as much time. This is a CAB volunteer speaking :):)

    These days, I am afraid, everyone from the council to the police to other voluntary agencies refer people to CAB. For some, at least, it is a box ticking exercise

    POPLA is an exercise in lucky assessors roulette .... the standard is truly shocking .... a significant number of them are inept.

    I used Jopson case and similarities between them and ours. Recently popla seems limited to up to 2000 characters you can't make long stories in there.
