Not having enough money to pay the full amount is no defence, because the alternative option is to leave the car park and not use the service
But I checked the advertised price before travelling an hour to this car park. Upon arrival I find the price is higher than the advertised price, all I have is the amount they advertised and not enough to use any other local car park.0 -
So do what the deep said and report them to trading standards and to your MP, but you should have paid to park and then complained to trading standards, to your MP etc

Go to NEWBIE sticky, post # 2 and use one of the Bargepole's concise defences, add in the bit about Abuse of Process (search the forum for this) and add in the bits about "the defendant (that is you) has tried to engage with BW Legal on x occasions but has received no response" Now that you have told us the issue date KeithP will be along to give you deadline dates and he always posts this useful guidance: -When you are happy with the content, your Defence should be filed via email as suggested here:
- Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to [EMAIL="CCBCAQ@Justice.gov.uk"]CCBCAQ@Justice.gov.uk[/EMAIL]
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

I had an appointment I couldnt miss, so needed to park. If their advertised price was correct I could/would of paid. I was left 2 options, stay and attend my appointment, or leave and miss my appointment and travel back an hour wasting money and time etc. I didnt have time to find another car park, given that I had traveled with the correct remittance? I dont use telephone/online banking so cash was my ONLY method of payment

That is a terrible defensive. Who on Earth drives an hour taking only £5.50 with them to park, and why do you think that the price having gone up means that you can park for free?
You need to get your head around what a legal defense means, what you are relying on is not one. It’s irrelevant anyway as your busy life means that you simply can’t attend.

Your circumstances and the incorrect website charge are largely irrelevant
You get there, pay the £6 and go about your business, as detailed on the payment machine when it wanted you to pay £6 and confirm a parking contract

I disagree, and I think that most judges would too.You never know how far you can go until you go too far.0 -
You can simply copy & adapt in about an hour, the example earlier this month where I posted that it was a perfect defence which IMHO is a mix of bargepole's concise one, plus a rant about costs, plus some facts about the defence in the middle.
If you can't turn up to the short hearing, you'd better get your head around the costs that are made up out of thin air and be prepped to nail this at WS stage, or you will lose and will be hit for all costs. You not turning up is a huge problem for YOU.
Also, if you are not going to show up, this is on your head as you are not following our advice at all, and we know how to win these cases (not by talking about only having £5.50 with you).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
