Bw legal not responding to my letters or emails....

So I have been sent a letter saying they are due to start court proceedings and I have 14 days to reply. I have asked the courts for another 14 days to enter a defence
In the mean time I have been sending letters and emails to BW LEGAL about this matter but thay have NOT responded to any of them. How can I discuss the matter with them if they don't respond.
I have decided on setting up a payment plan as I just dont have the time or availability to defend myself in court. Now the 28 days are up, I have still to enter a defence with Northampton court and I have had no responce from BW. what should I do, any advice?

You haven't given us a lot to go on.
Who is the PPC?
What correspondence have you had from them?
Have they added on a fake £60 to the original charge? This is an abuse of process and has caused other cases to to be thrown out by the judge.
Have you sent the PPC an SAR as per the NEWBIES?
Have you done the AoS (that gives you the extra 14 days)?
Are you following the guide to court from post 2 of the NEWBIES?
If you have no received anything then the scammers and their scamlicitors have breached the pre-action protocol, so you should direct your complaints to the court and SRA.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Yes have recieved all previous correspondence correct etc. Its got to the point where I have recieved the letter of claim, Aos has been completed and I have been trying to contact BW LEGAL ever since to sort thr matter out before court, but they dont respond0
-
Yes they have added £60, but I don't have time to go to court to defend the matter0

If you did the AOS it's gone way beyond a letter of claim to a live court case via the CCBC
If the 28 days is up with no defence filed then they can apply for a default CCJ and there is no negotiating it after that, so they are letting it time out due to you sitting on your hands
As you have decided not to defend it then there is no help or advice required, you are the architect of your own downfall and accj will arrive quite soon0 -
Think very carefully before you pay them. The entire industry is a scam which Parliament is at present drawing up regulations to seriously restrict. Indeed, at least one MP has suggested in the HofC that some of them may have links to organised crime. |The money you pay could go towards funding white salvery or the importation of class A substances.
Make a formal complaint about BW Legal here

Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. and seriously consider contesting the claim. You never know how far you can go until you go too far.0 -
RedX today is the last day I have to enter a defence, i cant see how I can defend my self when I dont have time to attend court. (Do these always end up in court??)
I dont want to pay, dont think its fair to pay, but have been trying to contact BW LEGAL with no responce, thats not exactly ignoring the matter (sitting on my own hands??) Is it?
If they are asking me to contact them to discuss my reasons for original non payment, which I have done with no responce, then what do I do??0 -
Can BW LEGAL not responding to my letters or emails form my defence as to why it's even got this far0
-
What do you think that contacting the company is going to do? They have chosen to go through the courts, they probably have no interest in dealing with you outside of the court system unless you are making a settlement offer; is that what you are doing?
What is it that you do that means you can’t go to court?0 -
It can be mentioned but only a judge can decide, not us
I do not believe that you actually know the difference between a letter of claim from b w legal and a claim pack from the CCBC
What you have there is an N1 claim pack from the CCBC in Northampton, not a letter of claim, where b w legal paid a £25 fee and you are expected to engage with the CCBC, not with b w legal, so what I meant was in those 28 days you haven't been doing your side in getting your defence filed
They do not have to engage with you, they paid for a court claim to let the courts decide
Post the issue date on the N180 claim form in your reply and draft a defence ASAP too
No you do not have to attend court, it can be dealt with on paperrs0 -
There are examples around where a defence is submitted when the particulars of claim are very scant (you haven't even posted that for us to see). You'll need to do some searching.
It'll need to include something saying how hard it is to defend something with NO information, and invite the court to either strike out the claim or force the claimant to submit better particulars.
You MUST submit something. Is the deadline actually today? Post up dates of the claim, and when you did they AOS.0
