    Personally I would challenge it due to what I said in my last reply

    The fact is that by making people use apps at the point of sale they make it harder to stay within the entry time grace period

    But a ticket was purchased to cover the parking time as soon as the driver was able to

    And the driver left promptly within the exit time grace period

    Therefore the driver was being reasonable

    So I would await a popla code and appeal

    Most PCNs are worth challenging. Nobody here will advise you to pay a bunch of scammers.

    Send the initial appeal in blue text from the NEWBIES, unaltered from the keeper.

    Upload a redacted copy of the PCN/NTK to a web hosting site such as postimage or tinypic or similar, then paste the URL here, but change http to hxxp. Someone here will change it back to a live link.

    You should also complain to your MP about this unregulated scam.

    Gosh! That's a leap!

    Most definitely worth challenging and if you do all the right things then success at POPLA is very likely.

    Search the forum for POPLA split grace periods. Copy what everyone else does! Easy as pie when you know not to refer to the overstay as the FULL period added together.

  • I have never appealed anything before is all. I just wanted to know if I was in with a chance of over turning it hence why I asked about paying.
    I really appreciate everyone’s advice. I will wait for the POPLA number and appeal it through them.

    As cm says, this is argued as 2 separate sections of time called grace periods, and what is reasonable

    I believe your first period was reasonable given what you did, even if it was say 90 seconds more than their computers allow, possibly due to mobile reception issues, slow app , non familiarity with the app etc

    Parking was paid for so no argument there

    And a reasonable time to leave was adhered to, so no argument there either

    Do not refer to any alleged overstay, it's two separate periods to comply with the parking rules

    You did nothing wrong, you acted in good faith, you acted reasonably

    This is not a fine, this is an invoice for the damage you caused them when you overstayed. Pay them not a penny unless a judge so orders, which, imo, is highly unlikely.

    Parking Eye signs are very unlikely to impress a judge, read this

    and enlist the support of your MP as they are obviously trying to scam you.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

  • So I have received my letter saying my appeal has been rejected. Shocker! Because I wouldn’t name the driver of course.
    They have now supplied me with the number to appeal to POPLA. Although they where kind enough to extend the reduced rate period if I wanted to pay it. ��
    I also got in touch with my local MP who have also contacted them on my behalf so we shall see what comes from that too.
    Thanks for everyone’s continued advice. I will update when I hear more.
