"as stated in POFA the 14 days starts the first working day after the breach, "
This is not true. The PoFA does not mention working days, only days. The assessors are making things up.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, I have got my partner to read over the appeal in which the assessor said I identified as the driver. He says I didn’t confirm or say I was driving.
Also, I looked into my description regarding the POFA. I quote....
“IP’s NTK was posted on the 16th July, arriving on the 18th July, day 15, a day to late for keep liability to apply, failing POFA 2012.
Date of alleged event 3rd July = Day 0
4th July = Day 1
5th July = Day 2 etc
18th July = Day 15”
Maybe I should have literally wrote it day by day, number by number0 -
You did all you could and the Assessors are wrong.
Complain to the Lead Adjudicator and say this is NOT a judgement call by an Assessor, this is miscounting of days and in addition, a wrong statement about when the 14 day period starts which does not only start on a 'working day'.
Both decisions are wrong in law, and a review and re-training are surely needed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay so on their website it states -
Unhappy with our service POPLA
At POPLA we take complaints about our service very seriously. If you think that we have done something wrong please let us know so we have the chance to put things right quickly and effectively. Your complaint will help us learn from our mistakes and improve our service.
Sometimes the outcome of your appeal is not what you want to hear. Your appeal has independently been reviewed by a professional assessor taking into consideration the relevant law, regulatory rules, guidance and standards and the British Parking Association Code of Practice. You cannot challenge the outcome of your appeal with POPLA. Regardless, you should be satisfied with the level of service you have received free of charge from us. If you disagree with the outcome of your appeal, you will need to follow alternative routes.
We can only investigate complaints that involve allegations of poor service or performance, for example where we have:
treated you rudely;
failed to keep you updated on progress;
caused unnecessary delays;
failed to explain things properly; or
any other shortfall in service
If you have a complaint about the standard of service that we have provided, please send us an email to info@popla.co.uk
So this shall be the email I draft a reply to? So I need to do one email for each appeal?0 -
Just to confirm my assessor for both appeals was different people0

Just try keywords Complaint Gallagher eliminate common words like ‘POPLA’ and ‘John’, which makes the search too wide and will likely bring up too many irrelevant results.
HOW TO USE THE FORUM SEARCH FUNCTION:
Hit your 'Back' button to get back to the forum thread list. On the bar just above the threads you'll see the 'Search' function. Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I’m trying to start building a complaint letter now. But to be honest it’s getting me very stressed out, and playing on my mind a lot! Part of me just wants to pay to get it dealt with and rid from my life, part of me wants to fight . Eurgh!0

Direct your stress towards POPLA and allow it (without ranting) to write a stern complaint covering the points you want to make. You just need to go back over the last few posts to see that you want to explain to John Gallagher that the assessors have erred and how they have done so.0
