Google is quite good for finding things out.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

hi, on their website I have to collect from a drop down menu and I am not sure what to pick

    - I have a valid ticket/permit for the car park/site which was clearly on display
    - my vehicle is permitted to park and is on vehicle exemptions list (whitelist)
    - I had a pay and display ticket but may have entered the wrong or incomplete registration
    - my vehicle was not in the car park at the time the contravention occurred
    - I did not park for the stated time
    - I was authorised to park
    - there was no signage at the car park/location indicating any restrictions

no sure what to select, I am guessing the first one for the morning ticker will be did not park at the stated time, as persons inside didn't leave the vehicle etc

but not sure about the second time in the evening?

Is there a box marked OTHER? If not and none of the offerings suit your circumstances, the advice I have seen is to e-mail to the address on your PCN or post it to the address given on the PCN (use First Class and ask for a FREE certificate of posting.)

    Hi,

Unfortunately no, I didn’t see anything saying “other” which is very annoying. So I’m guessing now I’m going to have to appeal by post which isn’t very ideal 😞

Have another look just in case.

Post will be okay though. Don't forget to ask for the certificate of posting.

As advised above, send it via email or by post, or better yet, both. To send it by post, do so first class from a post office counter and ensure you obtain a free proof of posting.

Also complain to the BPA that the scammers do not have an "other" option or a method for a keeper to appeal. Point out that the only options available are tantamount to an unfair contract where a keeper is concerned.

Send a similar complain to the DVLA that there is no option for a keeper to appeal.

Your complaint to your MP should be a simple statement from the keeper in their own words.

You could mention that the parking companies are currently unregulated. Quote the comments in red from post 1 of the NEWBIES made by MPs in open parliament, and that a new parking bill has been introduced to stop these scams, but there is no mandatory code of conduct in force yet.
Point out that a driver may or may not park incorrectly but the keeper, who may not even have been in the car at the time is made liable because of the unfair terms in the PoFA. No other country in the world allows a private entity to take someone to court for something done by a complately different person.

Also mention that the scammers use ANPR scameras, even though the UK Government prohibits their use in council carparks because they are not fit for purpose and often have up to a 50% failure rate. Because the scammers are unregulated, they can use this proven unfit technology to obtain money

In your case the scammers have failed to comply with the PoFA but are still pursuing the keeper even though they are not liable. Many people don't realise this, get frightened by the threatening words uses, and just pay up which is how the whole rotten industry works.

I can confirm as I’ve just checked again, ensuring I selected KEEPER,that there is no “other” option in the drop down menu, and it doesn’t let you submit your appeal without selecting one of these options 😤

There is one email for the online, under the “contact us” page, so I will email that twice as I have to PCN. I will also then print the letter and post these both tomorrow first class and get proof of postage 👍🏻

Then Next stage is finding contact details for my MP, and then also for the DVLA and the BPA.

This is so crazy how long winded and difficult they make things, just hoping people would pay up straight away. If it wasn’t for you guys I probably would have been one of those people so thank you
