    Agreed , the exhibits cut down on the length of the WS , hence why they are supplementary

    Hi All,
    Just wanted to give a heads up that my case is heard on Thursday. Since the last post we have had a baby so the little time I had before had become A LOT less! However rest assured I am still 100% committed to throwing everything at it to get the right result! Come too far not too. 
    I asked on another thread whether a skeleton argument was necessary? I was going to write a page of bullet points that summed up my points and referred to the many case precedents that I rely on (and add some further ones that have happened since my WS). But some say it's superfluous... Any thought on this? I am prepared to do a Skeleton Argument justice but at the cost of my SO's sanity!!

    I'd write one a bit like a shopping list:
    28 packets of pasta
    42 hand sanitisers
    120 packs of toilet rolls ........ 😩


    to cover the main points of your Defence and WS that you would wish to remind the judge about. You won't have long to say anything in court (if anything at all), so keep everything short and to the point (bullet point style) and not a simple repetition of your D/WS.  One side of A4 max, I would say. 

    You must send a copy to both the court and the claimant around 7 days prior to the hearing. At the same time (if you've not already done so), send your Costs Schedule with it.

    I wasn't aware of the 7 day deadline though? I thought it was a few days before. I'll write one and send it anyway.

    There's no limit since there's no requirement. 2/3 days is fine.

    As above, no official deadline, but I do recall a case last year where the judge said a few days before the hearing was too late. No specifics, but I tend to advise going with this 7 days prior. 

    Advice given in good faith, but ultimately up to you @OP on when you decide to submit (if you decide to do so at all).

    So Skeleton Argument went across to court and claimant today. Bullet-pointed my original defence and also touched on the Abuse of process stuff in my Defence and WS. I also noted that their witness statement is invalid to preface the almost guaranteed possibility that they don’t send a member of BW or Premier P to court.  
    Let’s see what happens! 
    I feel very confident but who knows what Judge I’ll be assigned. Let’s hope it’s not Judge Rinder!!
