Free parking for customers but i entered the wrong reg.

Hi,

I received a parking ticket due to circumstances that is a little bit different to the norm and wondered if I had a case to appeal.

The wife and I drink in the same town centre pub every other Thursday which has a pay car park but has a system where true customers are not out of pocket when parking. You can pay for the parking and then receive the money back from the pub when you buy a drink OR you can use a reg. entry machine in the pub to validate the park. I usually use the 2nd option but in the case of the parking ticket I entered the reg. of MY car instead of the car that was parked - a genuine mistake.
Ive read thru a few of the previous posts and wondered if the following would make a claim difficult :-
  • I cannot prove I was a customer of the pub and entitled to free parking (all transactions in cash)
  • The evidence that i was a customer of the pub but entered the wrong reg is in the hands of the parking company
  • I cannot claim "no lose of income" because I cannot prove whether i had to pay or not.

Would the parking company have to prove i wasnt in the pub or do i have to prove I was in the pub and made a mistake.

Thoughts?

Your first port of call is to the pub manager , let him know how much he will loose is he does not get this cancelled.

Complain to the pub, they can cancel these scams.

The NEWBIES thread tells everyone to complain to the landowner, first.

Throughout here you are advised never to reveal who was driving

You need to edit your post to remove details of who was driving

The ppcs monitor this forum and can use posts in your thread against you in Court

Many judges regard a wrong VRN as a trifling matter,

    https://en.wikipedia.org/wiki/De_minimis

not really a breach of contract at all, but an attempt by scammers to use court as a debt collector.

As nine times out of ten these tickets are scams, complain to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.
