Ccbc Albert Street vcs

I've read all of the old posts. And newbie threads.

I received a ccbc claim form. I've submitted my Aos.
I've written a draft defence

But my question is. On the particulars of claim it states that the 'defendants vehicle was identified in the Albert Street, brimingham on 07/05/2016'

Now Albert Street Birmingham is a public highway. They obviously mean Albert Street car park but that's not stated.

Should I state this on my defence? If so how should I word it?

I've requested all info from Vcs but they've not responded. (emails sent and websites form) I've also rang them twice today and still nothing has been sent.

Any help would be appreciated :-)

    So they get 40 days but I have to submit my defence in 28 days, surly that's ridiculous?!

    But I won't not submit my defence in time regardless.

    No. They get one calendar month to respond to a SAR. You have thirty three days to file a Defence.

    There was nothing stopping you sending them a SAR earlier - at Letter of Claim time perhaps.

    Anyway, most of the information returned will be of more use at Witness Statement and evidence time - some months away.

    With a Claim Issue Date of 3rd July, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 5th August 2019 to file your Defence.

    That's nearly three weeks away. Loads of time to produce a good Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    You were meant to send a SAR at LBC stage, as per our advice.

    Never too late though, as you get to see all letters & photos before WS stage.
