Ps... In my written letter of appeal, should I inform them that I tried to appeal via their online form but that their Charge Notice Ref isn't recognised.? And should I also write that because of this, this makes their letter not valid in this claim. The actual date of incident was 23rd June (as shown in their pics) and they wrote to me on the 4th July. Have they got a certain amount of days to issue me their PCN, and if so, then as their letter can be seen as invalid due to incorrect information ie unrecognisable ref no, then they would have to reissue me with another letter for this offence. Though I'm understanding that they can't issue me twice for the same offence.... Once again, thank you for your advice.

If your complaint to the BPA sorts out the online appeal problem within the 28 day appeal window, then there will be no need to write a letter of appeal.
If the BPA don't get the problem resolved, then send the appeal template in blue text in the NEWBIES, sent unaltered by The Keeper from a Post Office counter, obtaining a free proof of posting.

The dates of when the NTK should be received are explained in the NEWBIES. It looks like the NTK was received within the PoFA time limits, but that doesn't mean that it complies in other respects.

    Nothing makes an invoice invalid.

    No offence has been committed.

    Edit,

Your dates don't add up. The 7th of July was a Sunday so the NTK can't have arrived then.

  • Thankyou all for your help and advice. I have copied the template and shall send that off to them without signing it or putting my name on it - just my address. I wont add that their Ref no isn't recognised on their website appeal , hence why I need to do this appeal by post, but I will date it as today. Thankyou kindly.
  • hi Fruitcake, so should I send the template copy now as my appeal - or send to them my written appeal stating the reasons for it ?

You need to sign it. If you don't put a name on it how do they know who it's from? They already have the registered keepers name so you appeal as the registered keeper.

You have been advised to complain to the BPA, and send the appeal template in blue online once the online appeal problem is fixed by day 28, or by post if it isn't.

I don't understand why you have asked for advice but keep wanting to do something different when given advice.

You will need to include the PCN number and The Keeper's name and address, and VRN. Attach a copy of the PCN with the appeal. Take a screenshot or paper copy of your appeal.

Do not send anything to anyone until it has been checked on here first

Hi Waamo, all the letters here and on the newbie template say not to put your name down...which is why i wasnt going to sign..

    That is not true.
It tells you to add the Keeper's name.
It tells you not to name the driver.

You need to spend more time reading the NEWBIES. Slow down and don't rush this.

  • Ok, I am sending off the online blue template from the newbies forum and stating my name as the registered keeper, my address, vehicle reg and their pcn number. I only want to know if I should add to the letter that I was unable to appeal online because their given pcn ref no wasn't recognised on their online appeal. So should I include and inform them of this info, or leave it out altogether ?
  • yes I see - sry as im a shift worker and currently on nights inc tonight...
