Quite often when CP Plus receive a forum initiated template appeal, they cancel the charge. They know they can't win at POPLA where it will cost them money to try. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So after they reply, the next step is PoPLA?
No, as Umkomaas says, CP Plus will give up when they read the NEWBIE template.
Very easy one!
And they haven't screwed up. CP Plus almost never use the POFA, hence why they are so easy to beat (like Smart and Highview).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The driver and the vehicle owner are very happy.
Thank you all for you help.0 -
well done .....
you still need to understand what the rules are for parking there .....
or this could turn into a ' ground hog day '
this should happen every time you use a private parking site.

Did you send the SAR and DVLA requests as advised to flush out any future PCNs?
Did you complain to your MP as advised? This is the only way this scam will ever get stopped, and it's your way of helping now that we have helped you get this cancelled.
Have you told all your friends and colleagues what to do if they get any scamvoices?
Have you got you Union rep involved?I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -

Regarding the SAR, I will use the template from the link on the Newbies thread, but I have a question relating to the list of what to request as a minimum.
Do I need to adapt that list into fully formed sentences or shall I leave them as points and insert them where the template indicates to do so?
Edit: This is the list and what I think should be included -
- ALL photos taken - YES
- all letters/emails sent and received, including any appeal correspondence earlier - YES
- if the car park was Pay and Display, ALWAYS ask for a PDT machine record from that day, of payments made (VRNs can be partially redacted but insist on getting this and follow it up if they refuse). - NO
- all data held, all evidence they will rely on, and a full copy of the PCN, NTK - YES but only the PCN as I didn't receive a NTK?
- and a list of all PCNs they consider are outstanding against you and/or this VRN, and remind them that any claim must be for all PCNs in one claim, not several separate claims. - YES0 -
That covers most things I think, but where you say data and evidence, it can only be personal data and evidence relating to personal data/correspondence.
They are not obliged to provide anything about signage or contracts, but that would be required should a court case ever happen.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -

Send a request to the DVLA asking who requested the keeper's personal data and when from a date before the alleged event until now. Say that you believe this service to be free.
The SAR and DVLA request will flush out any other PCNs.
Is there a letter template of what to say to the DVLA to request this?
Have looked in Newbies thread but I might be missing it..?0
