Hi

I have read the Newbies thread but I feel like this situation is a little different.

The driver of the car is an NHS worker for a hospital and has been parking in the staff carpark since January without a valid permit.

Their colleagues do exactly the same; some as long as two years, and have not received a fine.

As a newer member of the team, they have just done what their colleagues have been doing.

Yesterday the keeper of the car received a Charge Notice in the post with photographs of the car in question going in and out of the carpark and a fine of £50.

The driver’s first instinct is to just pay.

Anyway, the advice they would like is as follows:

The date of the fine is from over a month ago; early June. Does this mean the reg will have flagged up every day since, and will they start to receive letters for every day they have parked there since?

The letter is dated very early July but it was only sent yesterday, with 2 days to pay the cheaper fine, before it doubles. They feel like they have sent the letter late, on purpose, so that they have little time to do anything and just cough up. Is this something they can contest?

    These parking companies are bottom feeders that prey on the good nature of kind hearted people like yourself. You should edit your post so that the driver cannot be implied. Refer to the driver in the third person, e.g. "the driver parked".

    It is not a fine.

    Your case is no different from anyone else's we see here every day.

    You must urgently edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    Do this before you do anything else, as well as remove all suggestions of guilt.

    The keeper has protections in in law that the Driver does not. From the sound of things the NTK has been sent too late for the keeper to be liable.

    Send the appeal template in blue from post 1 of the NEWBIES, unedited from The Keeper.

    What is the name of the PPC please?

    yes you should , using the blue text appeal, unchanged , as keeper, same as everyone else is also told to do

    This is important. Far from doing something sly, the PPC may well have messed up.
  • Appeal has been sent.

    Without asking you to do all the work for us (I really appreciate the advice so far), would you recommend I read up on any specific thread or post in preparation for their reply?

    Nobody else should be appealing. Nobody else should be involved. If the NTK was sent to The Keeper by post then of course it is them that should appeal.

    CP Plus are BPA members, so PoPLA is where this will be won.

    What is the date of the NTK?
    What was the date the NTK was received by The Keeper?

    The date of the alleged event was 12/06/2019.
    The date of the NTK is 02/07/2019.
    The date the NTK was received was 12/07/2019.

    Edit: and the date the charge will increase is 16/07/2019.

    if there was no windscreen ticket then they screwed up on timescales for keeper liability under POFA (14 days to get it to the keeper)
