Court letter from VCS

Hi all,

I’m making a new thread as I’ve read through the newbies section (all morning) and other threads on this topic but can’t find the response I need...

I have a letter from the courts (notice of proposed allocation to small clams track) and was wondering what my options are.
I intend to defend the claim as 1. I’m not the owner of the vehicle cited, and 2 I believe I was out of the country at the time. Indeed I’m not even sure how they have linked the cited offense to me! The paperwork looks quite intimidating threatening with court, mediation (I need to pick one of the other as don’t want to ignore paperwork from a Court)

Any advice would be appreciated as the form says I need to respond before 19th July...

Do you have a court claim N1 claim form from the CCBC in Northampton ?

Or has the defence already been filed ?

What is the issue date on any claim form ?

Hi, thanks for reply.
I don’t have a N1 form. The form I have is asking if I’d like to take up an offer of mediation to avoid going to court.
My defense was mentioned in a form I sent off stating I am not the owner of the vehicle and was not driving it on set date.

The issue date seems to be 2nd July and I must respond by 19th July.

Sounds like you have previously received a County Court Claim Form and filed a Defence.

Have you now received a Directions Questionnaire?

If so, you need to be reading Bargepole's 'what happens when' post linked from post #2 of the NEWBIES thread which explains exactly how to answer every question on the form.

That is exactly what I have received. I’ve searched throughout that thread already looking for what I should do next but have been unable to find the advice I seek....

The information you are looking for is there.

When you have a moment, it might be a good idea to post here the Defence that you have filed - with personal information suitably redacted of course.

The defense was that the car is not mine and I certainly was not driving it on the date of alleged offense.

Are those the actual words you used?
Is the complete Defence you filed with the court?

Please post an exact copy of what you filed with the court - but as mentioned before, no personal identifying detail.

Yes. I simply have never owned a car with the registration they claim on the letter before claim form. Also I wasn’t in the place where this vehicle was illegally parked on the given date (18 Aug 15)

Let's be clear...
You have now told me that those were the exact words that you filed as a Defence.

Is that right?
