  • Ok. Basically this is extremely simple..

    You DID have a contract with Sky, for 18 months. You did NOT cancel. (All subscriptions require cancellation.. sorry but they just do).

    You then phoned the bank and lied to them about fraudulent activity.

    This is really all your own doing.

    Why did you phone your bank and claim fraud? Any normal person would have phoned sky, cancelled and got a refund on that last payment.

    There you go. Easy explanation.

    Good luck getting this removed ;) you've been very silly. Sorry to be the bearer of bad news here.

    Thank God Columbo has turned up to solve things for us.

    Unfortunately for you, you'll find that people have explained the reason for the marker a page or two ago and it's still extremely harsh given the circumstances.

    1. Then why couldn’t Sky produce this “contract”?

    2. Why would Sky close the account and not pursue the OP for the money due under the contract, if they had one?

    I read the whole thread. No one gave him an answer. I did.

    That IS the reason. He lied to the bank. Simple as that!!!!!
  • You guys are not so wise. Just because you post a lot here..

    His bank will have put the fraud marker after investigating his claim of fake fraud. He will soon get a letter off them telling him his account will close. (Account closure doesn't always happen immediately)

    The guy is a bit dim, obviously.

    And you're saying that the bank was convinced enough to brand him a Cat 6 fraud (to the prosecutable standards that CIFAS supposedly require) in October 2018, but are happy to continue having him as a customer even now, more than 9 months later?!

    Well Ozzy, when you're dealing with people who are only semi-literate, I think you do have a problem. This is from your CISAS email:

    Unfortunately, you will now need to liaise with the ICO. As mentioned previously, maybe now is also the time to seek legal advice; perhaps to start with from a firm that offers a cheap rate initial consultation.

    Have you suffered any material loss as a result of this debacle? Losing out on a mortgage - and possibly having to settle for one at a higher interest rate - might just qualify as such a loss. Again, seek legal advice about this. If you have suffered a loss, you should be looking for compensation from the perpetrators.

    Thanks John. I've already lost the brokers fees, mortgage application fees and the Amex charge card fee as they've closed the account. If the property purchase falls through, I'll have lost solicitors fees too.

    You really need to stop faffing about and hire a solicitor to send Sky a legal letter to sort this out if you are in the process of buying a house and need a mortgage.     The house purchase is still at a standstill due to the situation. I know they've had other offers but I did pay quite a bit over asking which has bought me some goodwill with regards to time. I think I have a week, or two at best to get this sorted and I'm hoping the letter I sent to CIFAS gets them to take action

    It won't.

    I told you, the only way to resolve this in your time frame is by involving a solicitor and getting them to send Sky a legal letter outlining compensation that they owe you for brokers fees, mortgage application fees, Amex charge card fee etc. plus also a monetary amount for stress/inconvenience of trying to sort this out in the first place and to remove the marker from CIFAS with immediate effect or within a deadline of x-amount of days or further court action to be taken immediately. From what you've said, Sky don't have a leg to stand on and will likely cave and pay up/sort out the mess.

    If you're not bothered about losing the house or the fees etc. that you've paid out for, then by all means, carry on with your one man crusade to nowhere, but be aware it will take months to resolve and by then you'd have lost the house and have no chance of recouping any monetary losses plus also inevitable closures of other banking/credit facilities you have.

    Oh and ignore Inspector Clueso above, obviously someone with an axe to grind who signed up just to be an annoying troll.
