Unwarranted Cat 6 Cifas Marker from Sky

    Thanks sourcrates, I did the SAR to CIFAS and now Sky do agree the marker is unwarranted, they insist they don't know how to remove it though. I've explained to CIFAS but they do not want to help, they've told me to go back to Sky as they have definitely loaded the marker and if that doesn't work, I can go to the FOS.

    So a mini update, I just spoke with FOS as directed to by CIFAS. They've advised that they can't deal with the matter as Sky is not a financial institution and told me to get in touch with the Communications Ombudsman who will help.

    Spoke to the Communications Ombudsman who advised they can't deal with the matter as Sky is not a member and I should contact CISAS. CISAS close at 5pm so will be trying them tomorrow.

    Just feel like I'm being palmed off by everyone I speak to! :(

    What was interesting though was that the FOS seemed to think that it may not have been Sky that loaded the marker, they seemed to think it would have been a third party such a CRA that woul have registered it on behalf of Sky. No idea how true that it though

    Yes, ICO now. Also, if Sky don't play ball pronto, advise them that you're seeing a solicitor about the matter.

    What they’ve told you is simply untrue.

    Sky UK Ltd. (sky.com) is regulated by the FCA as a financial services provider and the FOS database has a case where they’ve adjudicated on a complaint by a Sky mobile customer.

    Thanks guys, I'll get on to ICO tomorrow as well as get back in touch with FOS. I'll try CISAS too just to cover all bases

    So it seems I've hit a brick wall again. I've still not received the letter from Sky - they sent me a copy of the letter by email yesterday though and the content is nothing like what was agreed last Friday. I've attached at this link: https://imgur.com/a/Bc5B5M8

    I spoke to FOS again who said they can only deal with Sky Mobile complaints as Sky Mobile is a credit provider. I spoke to CISAS on the phone and was told that they should be able to help and I should put a claim in online. Did the claim yesterday and got an email today saying they couldn't help with the matter. Email can be seen here: https://imgur.com/a/awkkHvo

    Contacted the ICO who advised me that they may be able to help and I should file a complaint to them but it would take around 3 months to be looked at :mad::mad::mad:

  • Well Ozzy, when you're dealing with people who are only semi-literate, I think you do have a problem. This is from your CISAS email:

    Unfortunately, you will now need to liaise with the ICO. As mentioned previously, maybe now is also the time to seek legal advice; perhaps to start with from a firm that offers a cheap rate initial consultation.


    Have you suffered any material loss as a result of this debacle? Losing out on a mortgage - and possibly having to settle for one at a higher interest rate - might just qualify as such a loss. Again, seek legal advice about this. If you have suffered a loss, you should be looking for compensation from the perpetrators.

    Told you it will take months to try and fix it yourself. In the meantime, how is your house purchase going?

    You really need to stop faffing about and hire a solicitor to send Sky a legal letter to sort this out if you are in the process of buying a house and need a mortgage. Have you spoken to the solicitors dealing with your house purchase to see if they have anyone who deals in similar issues/senior partner who can send one?
