    You will all have to excuse my lack of knowledge re this, I thought sending my defence by email was the only thing I needed to send..i dont have any witness statements or evidence other then one or two pictures of the place ...so as much as I may come across thick what do I need to produce for the court and claiment?

    So basically the witness is only me ...and I now have to write a statement telling them what happened on the day of question and any pictures I may have ? Thats it?

    Those are the basics , and the defence was never the only item to do, read the posts by bargepole from a few years ago linked in post #2 of the newbies thread , plus read completed court cases in other threads , read what they have done so you know what to do, which I have already told you the 3 things to prepare for your submission bundle

    Hand one bundle into court and get a receipt , email the same bundle to VCS , no later than 14 days prior to the Court date

    Bear in mind the SAR should have given you some of their evidence , plus pictures of signage etc , helpful transcripts , quotes from laws , the IPC CoP , your costs schedule , all sorts of evidence for the submission bundle

    That letter commands both parties to do this with a deadline

    I am not sure why you are not doing your research or reading threads etc , it's in hundreds of similar court case threads , some in progress and some completed

    That can be remedied by reading the stickies/FAQs and other similar posts on here. This is a self help forum. it is a complicated subject, and a wrong move could find you with a CCJ. It is essential that you understand the rules of the game you have been dragged into, (or pay the scammer).

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    Appreciate all your help guys and I do understand it must be annoying when ppl ask the same thing over and over .
    One thing I did forget to ask was I sent a SAR off to VCS and have never received anything would I have to take that as them not having any evidence or would I need to re request one in case they make out they never got one ?

    Doesn't really matter

    You emailed a SAR I assume , to the DPO at VCS , giving 30 days notice to reply , plus attaching proof of ID

    If yes then as they failed to reply within 30 days , you follow through on reporting them to the ICO due to their breach of the law

    Nothing to do with your case or any court case

    The GDPR is not dependent on any court case etc , it's about obtaining your data under the law , regardless

    Would reporting them to the ICO be beneficial if they turn round and say something like it got lost in the post .
    How would I report them to the ICO anyway?

    Google it and read all about the ICO , Google GDPR as well

    You did the SAR and the SAR should have stated the 30 days to reply which is standard , otherwise you would have threatened to report them to the ICO

    So follow up on your threat

    Frankly , I am amazed that you have issued a SAR under the GDPR without knowing what it is and why you did it, you should have researched it so you knew what it was , why you were doing it and the consequences if they failed to reply to the SAR

    Your SAR has nothing to do with evidence , it's your data

    If you researched these topics , you wouldn't need to ask basic questions

    Went into Court and the judge awarded me the case so I won.
    VCS tried to appeal but the judge denied it.

    Well done you. When you get back down to earth, could you give us a short court report please? What happened, did they field an advocate, how did he/she perform, what did the Judge say, etc ......

    It really will help us, and others who eventually tread this same rocky path to understand reasons why Judges send private parking companies packing with a flea in their ears.

    Did you get your costs awarded by the Judge?
