County Court Claim - Doncaster Airport - stopping in a no stopping zone

Advise required please.

So I've received this county court claim 4 years on from the initial letter.

I've completed my AOS and now need some help with my defense.

I'm still going with my initial reply (made to VCS back in 2015) where i stated:
This is an appeal/challenge to the PCN number above.

Whilst driving to collect a friend from Doncaster airport my engine warning light came on, at the same time I was on the roundabout so decided to turn left to find a SAFE position to stop and check. This was a dead end so decided it was SAFE to stop.

I was not in a dangerous position as this was a dead-end.
Also I was not in position for no longer than a few minutes


ANY help would be appreciated

PS. I'm travelling to the US tomorrow for 2 weeks so i'm stressing about my time to defend..

    What is the Issue Date on your Claim Form?

    Did it come from the County Court Business Centre in Northampton, or from somewhere else?

    Please post date of issue of the court claim - hopefully Keithp will be along with the info you will need.

    In the meantime use Advanced Search with keywords ‘’Doncaster Airport defence’’ changing the search results button from threads to posts.

    You will find a number of defences which you can adapt to your circumstances.

    If VCS have added the scam £60 also search for ABUSE OF PROCESS

    With a Claim Issue Date of 25th June, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 29th July 2019 to file your Defence.

    That's three weeks away. Loads of time to produce a perfect Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Does this ticket mention bye-laws? Is the land covered by bye laws? Do they know who was driving? Are they quoting POFA?

    Most airport land is covered by bye laws, if this is the case, and they are unaware of the identity of the driver, they have very little hope of success as they cannot hold the RK liable. All is explained in the stickies and there are hundreds of threads on here concerning PCNs issued incorrectly at Railway Stations. Thet are trying to scam you.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
    You never know how far you can go until you go too far.

    Court date set for January, but the letter from court says the Judge has considered the statements of the case and directions questionnaires filed and allocated to the small claims track.
    They believe that the case is suitable for Mediation over the phone.

    Should i take this up?

    As a newbie i still cannot attach a copy of the letter due to restrictions on the website.

    Haven't you already considered that - when you completed your Directions Questionnaire?

    there are plenty of posts on this forum that specifically answer the "shall I try mediation" question , and why the usual answer is no (that mediation question is standard for the small claims track and is probably suitable in other civil disputes, but rarely in parking disputes)

    if you dont know the answer to it, then you have not read those posts nor the bargepole advice
  • What is the date and time of your case and where is it being held please?
    If it's in Doncaster I might come along to watch.
