UKPC are not being paid anything by the MA. These scam firms work purely by making money from penalties, that's all in 99% of cases.
So you can see why their ticketers arrive at 3am etc., and target residents, which goes against the excuse of 'reasonable regulations for the comfort of residents' which is all a MA should be doing.
Why not seize the moment to reply about 'parking' and ask the MA for a copy of the not less than 75% consensus (with no more than 10% objecting) they or their predecessor MA must legally have obtained from the residents, before inflicting this private nuisance of ex-clamper and admitted fraudsters UKPC on them, thereby undermining the rights in their leases.
Ask them did they know UKPC were banned by the DVLA in 2018 and admitted forging photos?
Also ask them why are UKPC even infesting the site and allowed near your cars, since they have such a terrible reputation (being a member of the BPA means nothing positive) and all they do is penalise residents and authorised visitors, delivery drivers, etc, contrary to persuasive case law - e.g. Jopson v Homeguard and Saeed v Plustrade to name just two - and are causing a derogation from grant.
Attach a copy of that L&T Act section (search the forum for L&T Act consensus).
Finish by stating that you do not recognise any rights that UKPC claim to have and reject outright any purported contract, and they need to know that if you or your visitors choose to display a 'permit' on some occasions it will merely be as a courtesy to show other neighbours that the car is genuinely authorised by the resident, and will not imply any acceptance of a contract nor obligation to display that permit which you explicitly reject and deny can override your lease.
As such, any placement of a PCN on any of your vehicles will be deemed a matter of trespass against your property and goods, and unjustified harassment. You will reserve the right to sue UKPC and/or even obtain an injunction to stop them, as occurred in the very similar case of Roger Davey v UKPC.
Also post a copy to UKPC. Keep proof of the date of posting to both.
If you then get a later PCN this will help in court to demonstrate your position was clear.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
