thank you for replying, apologies it must have been their WS.
i will have a search though and see what the other posts state. I am sure you guys don’t think so but the WS is pretty compelling to a normal person that has no experience at all.Is it worth uploading the WS so you can all see or is that a big NO NO?0 -

The RK would ideally like some advice on some specifics of the WS to make sure that the RK’s WS is a clear and concise as it can be. The RK is very nervous so any help will be greatly received.0 -

The WS is due on the 12/3 and the court date is May1 -
The RK received the court date confirmation this week and then 3 days later received the BW Legal WS.0

Difficult for posters here to give any clear steer on the WS as it is personal to him/her. It is just a narrative of what happened on the day and subsequently. For example "this is my WS in support of my defence as already filed and ............." Go to the NEWBIE sticky second post and search for Witness Statement and you will find some examples for style and format. You/he/she can include any rebuttal of the claimant WS in there. Post here for critique.0

I think I was over thinking it to be honest. If its just a statement of what happened on the day, I will compile and post as suggested. I thought I had to write chapter and verse “similar to my defence” on why certain aspects were not valid, ie signage, precious won cases, POPLA etc. More in depth than my defence, however if I understand what I have read on the newbies thread I do this but as example evidence which is just referenced in my WS.
As the RK was not the driver and this was stated in the defence, however the driver details have never been given. Does the effect my case?

It is a statement of what happened on the day and subsequently. You do have to provide evidence to back up what you say in your WS and what you submitted in your defence. It won't be similar to your defence but will back up and support it. You cannot add new defence arguments. Read some other threads about the same car park/PPC as your case. Search for them using Advanced Search on first page of parking sub-forum. If you have defended as RK and not driver, your evidence will need to support the fact that you were not driving - perhaps you were at work, on a train at a footy match for example BUT only be truthful - if the judge asks you outright "Were you driving?" what can you say.1
