Hi
I know you may have answered this Q before and I have read the NEWBIe but im still a little confused
I got a county court claim form on the weekend- called them up and its legit as I thought it was a fake one. Apparently, in May 2015 my old vehicle was parked there and I got a ticket- if im honest I dont recall anything on my car however a few month later received a letter saying I need to pay I think £100 I remember reading a post to ignore which I did. Never heard anything again. I moved since then and I have changed car twice and I got this claim for £185
What do I do as I have never been in this situation before? This car park is private land
Do I reply, do I pay or do I ignore or do I defend

Do not pay, did you read the NEWBIE FAQ properly?

As per the Newbie FAQ, send the PPC a subject access request (SAR) to find out all of the information they hold on you and all letters and correspondence sent to you regarding the allegation.
Then email/send a letter to the solicitors handling your case. Your letter can state that you have sent their client a SAR and so you require a restriction of data processing and the case should be put 'on hold'. Confirm your correct 'address for service' (especially if you've moved and they've traced you & might revert back to an old address).
Read the Newbie FAQ 2nd post it is relevant to you1 -
Thank you for a prompt reply
So I should get a solicitor involved?
DO i Contact Vehicle Control and ask them for this info? Do i reply back to county court?
FAQ2 - which one is that as the link i pressed there was nothing there0 -
Hey the link that I posted was to the Newbies FAQ written by Coupon-Mad which is extremely helpful.
Based on the FAQ, you would look for VCS data protection section on their website and contact them with an SAR - this would be free. Ask for (as a minimum):
- ALL photos taken
- all letters/emails sent and received, including any appeal correspondence earlier
- if the car park was Pay and Display, ALWAYS ask for a PDT machine record from that day, of payments made (VRNs can be partially redacted but insist on getting this and follow it up if they refuse).
- all data held, all evidence they will rely on, and a full copy of the PCN, NTK
- and a list of all PCNs they consider are outstanding against you and/or this VRN, and remind them that any claim must be for all PCNs in one claim, not several separate claims.
This way you will know what they hold on you and all the information regarding the allegation as it was a while back. - Another member should respond soon with timelines you should expect with a small courts claim as I am still a newbie my self.
Who has sent you the court claim, is it possible you could post a redacted letter. (Ensure you remove an identifiable details on the letter)1 -
Hi
I found the link and did the SAR to vehicle control and made an acknowledgment to MCOL stage 1
So I wait for Vehicle control now to get back to me right?0 -
The county court business centre in Northampton issued this on the 27th June on behalf of vehicle control0

It is time to start drafting your defence, look through the forums there is a wealth of information regarding past successful cases in the same situation. has a court date been set yet?. - If youre lucky you should get the SAR request back before your court date.
can you upload redacted documents, e.g. take a photograph and remove personal details and reference numbers so we can see break down, the claim etc.1 -
Please delete your post where you hijacked AcidTested's thread. You will be grateful that we are strict on this, if someone tries to hijack this thread later!
We want to see your draft defence once you've read other versions and examples.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
