This is just a bullying tactic they use
Ignore this and await your own dq to arrive
Don't agree to their request for this to be done on papers
You want a hearing!0 -
Thank you, I will wait for my own DQ.
Before joining this site I found out about requesting a SAR and because I am not english I paid 2 pounds to download a professional one online. Comparing it now with the advice from your site about what to request, not sure it was very good what I've written. I sent in on 28.06 over a month ago, got no reply though. Here is what it says main bits:
"confirmation that you are processing my personal data;
a copy of my personal data;
the purposes of your processing;
the categories of personal data concerned;
the recipients or categories of recipient you disclose my personal data to;
your retention period for storing my personal data or, where this is not possible, your criteria for determining how long you will store it;
confirmation of the existence of my right to request rectification, erasure or restriction or to object to such processing;
confirmation of my right to lodge a complaint with the ICO or another supervisory authority;
information about the source of the data, where it was not obtained directly from me;
the existence of any automated decision-making (including profiling); and
the safeguards you provide if you transfer my personal data to a third country or international organisation."
I just sent SAR to the Parking Co, not the solicitors. What can I do now as I want to request all the photos taken, all correspondence, all evidence they will rely upon in court and other stuff, maybe contract between them and landowner... I've been told that goes under CPR 31.14, do I write a request as such to the solicitors? Do I write another SAR or do I just forget about it and leave it alone?0 -
You can request all that info from the solicitors, which they may not do or only do half of it
Your SAR to the PPC may not have timed out yet, so leave it a few more days and email a chaser SAR giving them a further 7 days before complaining to the ICO about it
Ensure you used the DPO email address or postal address with the PPC, from their privacy page, not a general email, plus include proof of ID under the GDPR like a scan or picture of the N1 claim form or the V5C log book
You will only get your data, not anything that is not your data, they will rightly refuse to give you their landowner contract and other correspondence etc, as it's not your data0 -
Hi guys, I received the DQ last week, just filled it now and going to scan 3 copies tomorrow.
Gladstones asked the court to send me a form N159 as they want the hearing on papers only.
I want to ask you, do I fill this N159 form and send 1 copy to court and 1 to Gladstones as I am unsure what to do with it?0 -
No worries, I was being stupid it says on it just fill the bottom half of it.0
-
Do not fill in a N159 form.
You want a hearing.
To complete your DQ follow the guidance offered in bargepole's 'what happens when' post linked fro post #2 of the NEWBIES thread.
In there you will find out exactly how to answer every question on that form and how to challenge GS's statement.
Return a copy of your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence.
Remember to send a copy to the Claimant - address on your Claim Form.0 -
KeithP on the N159 form there are options to tick and one of them is I do not agree for the case to be dealt on papers alone.
It says I must tell the court whether or not I agree for the case to be dealt that way (papers only) by filling the bottom half of the form and send a copy to the court.
Are you sure I should not fill this form?? I read newbies thread how to fill DQ but there was nothing about this form that I could see...0 -
OK, tick boxes B and C.0
-
KeithP are you here? I filled DQ, I filled N159, I scanned, did 3 copies.
2 questions please:
1. To the court, do I send it to the same email as the defence? CCBCAQ@Justice.gov.uk? Put the claim number and the word DQ in the title? Or send it by post as it says in the letter they sent? It says to send it by post to their address.
2. Do I send copy to the parking co as well as Glad or just to Glad?
Waiting for your answer then will go ahead and do it.0 -
The CCBC is not a court, no idea where you got that idea from
It's a government office
Yes email the DQ to the same email address that you emailed the defence to, with the details you mentioned added
Send a copy to glad too0
