Hi all, thank you for the lovely messages. I am sticking around now that I feel confident and determined. I have started reading some of the forums and must say it takes a lot to read and advise which only goes to show how much time and effort you guys spend.
Brilliant to have you join us whenever you can. We all started as a newbie.
I met a guy at court who received dozens of CC Claims so he hired a guy from the private parking company paying him expenses and £50 + awards of costs by court
Do you mean he paid a (shudder...) parking appeals company ''expenses and £50 + awards of costs by court''? I believe that's illegal as a lay rep can only claim expenses, otherwise they overstep the mark in doing the work of a solicitor.

    Which appeals company?

Did you see this 'hired guy', what was his name/company and at which court was it?

We want to know who was charging that, despite not being a solicitor.

WARNING - DO NOT EVER TRY TO USE AN APPEALS COMPANY.

I know what I am talking about when I tell you how aggressive they are, even suing customers then boasting about it and warning people not to mention it on forums.
which made me think, these people are already in trouble and you are making money of them makes you no different than the PPC.
Yes, when firms are run like that. Avoid avoid avoid.

We even had a poster here touted by message, either on this forum or maybe pepipoo, who never posted again after realising his mistake when we told him to check TRUSTPILOT.

    Hi all,
received a PCN through the post as i did not display a valid permit for parking in a bay belonging to a housing association
why did i park in the bay? It was 10pm and i the road where i got a tickets backs onto my driveway. someone had blocked access to my driveway and i had my children with me so parked in the bay. The ticket was issued 12 11pm
i appealed the ticket on grounds of compelling reasons, to which they have dismissed.
can i still get out of it? do i have to pay?
    any advice pls

here is there statement to me

The Appellant should understand that the Adjudicator is not in a position to give legal advice to either of the parties but they are entitled to seek their own independent legal advice. The Adjudicator's role is to consider whether or not the parking charge has a basis in law and was properly issued in the circumstances of each individual case. In all Appeals the Adjudicator is bound by the relevant law applicable at the time and is only able to consider legal challenges and not factual mistakes nor extenuating or mitigating circumstances. Throughout this appeal the Operator has had the opportunity consider all points raised and could have conceded the appeal at any stage. The Adjudicator who deals with this Appeal is legally qualified and each case is dealt with according to their understanding of the law as it applies and the legal principles involved. A decision by an Adjudicator is not legally binding on an Appellant who is entitled to seek their own legal advice if they so wish.

The Operator has provided evidence of the signs at the site, which make it clear any driver parking without clearly displaying a valid permit in the windscreen, or outside of a bay, will be issued with the parking charge notice.

The Appellant claims that they had to park as they did as their driveway was blocked. Whilst I sympathise, I am unable to allow the appeal on this basis. The terms are clear. The guidance is also clear that I may only consider legal issues not extenuating circumstances. Only the Operator has this discretion.

The Operator has provided photographic evidence of the Appellant's vehicle parked on the land they manage, outside of a bay, and without a permit displayed. The appeal is dismissed.

Please start a new thread of your own. No answers on a thread which belongs to another poster, otherwise advice becomes mixed and confusing.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

What is happening with newbies posting on this thread?

Fiz1990 you don't have a hearing with 'Gladstones'.

They are not the Claimant and nor will a Gladstones employee turn up, (a freelance legal rep with no 'rights of audience' will).

Jack Chapman's signature is specific to claims by UKCPM.

NO REPLIES HERE - THIS IS NOT YOUR THREAD & YOU WON'T BE NOTICED.

Yep, please do!! Just go and sign in with him and take with you, a copy of the Lay Representatives (Rights of Audience) Order and correct the Usher if they say 'oh, so you are the Mackenzie friend?'

Nope - lay rep - the Defendant wishes you to speak for them. Hand over the Order of queried, At Soton I did that and the Usher scuttled off to ask the Judge in advance and I never got the Lay Reps Order back, but he didn't bat an eyelid at some random woman (me) speaking for the two Defendants!

    .
Do you have to complete and/or handover any documentation to be a Lay Rep or do you just inform the Usher beforehand? Thanks

nope, no documents to hand in, just say you are the lay rep to the usher, you may also have to let the judge know as soon as you enter the room.

    Hi Guys,

I received this reply from SRA re: Jack's signature complaint. They have decided to investigate further into the matter. cannot be long now.

Your complaint about Gladstones Solicitors Limited
Thank you for your email of 30 December 2019, addressed to my colleague David Clare. I am sorry for our delay in contacting you about the concerns you have raised.
I have carefully considered the information you have provided concerning the witness statement you have received from Gladstones Solicitors Limited (the firm) and the concerns you have about the firm’s practices. I have decided that your concerns need to be investigated further.
Information about our investigations can be found on our website at https://www.sra.org.uk/sra/decision-making/guidance/investigations-gathering-evidence
    What we will do next
We will pass the report to another Investigation Officer to look more closely at your concerns. At this stage, we cannot give you the name of the Investigation Officer who will be investigating the matter. However, upon receiving the matter, they will review it and aim to contact you by 4 March 2020.
    Our Investigations
Where we identify serious breaches of our rules, Standards or Regulations, or serious risks to consumers, the public or the wider public interest, we will take action. However, we close most of our investigations without taking any formal regulatory action.
That can be because, following investigation, we find that there has not been any serious breach. Or, where some breaches have occurred, the firm or individual has recognised this and taken steps to make sure they do not happen again.
Our Enforcement Strategy sets out how we consider seriousness and the factors we take into account. This can be found on our website at https://www.sra.org.uk/sra/strategy-2017-2020/sub-strategies/sra-enforcement-strategy.
    Your information
We aim to be transparent about our investigations wherever possible. We may disclose the
information you have provided to us to Gladstones Solicitors Limited, if we think it is
appropriate to do so. We may also disclose information to third parties including those
involved in regulating the profession or law enforcement. If you have any concerns about
this, please discuss them with the Investigation Officer when they contact you.
Thank you again for reporting your concerns to us.
    Yours sincerely

Suppose they will ignore the great Gladstones/IPC scam that damages so many people.
