I think it's windscreen PCNs that Tito of TPS can't produce for old cases. Not NTKs.

And you MUST confirm your correct 'address for service' to Tito and BW Legal as it remains dangerous to have two addresses in play.

We wouldn't put it past scum firms like these to serve a claim at the old address.

So you must contact both, to insist they ERASE the old address data and you should reiterate your address for service, and dent liability but say you are 'seeking debt advice' (which puts any claim on hold for 30 days, coincidentally just enough time to get the SAR back!).

    P.S. Hello Tito!

Tito is the MD of TPS, he reads this forum and he like replying to people by their MSE username to try and fail, to intimidate posters here:

    https://forums.moneysavingexpert.com/discussion/6016392/have-i-been-compromised

You need to ask Tito to call you 'alienfromzog' like Big Boi, there in the link!

What kind of sad individual would write to people and call them by their MSE username to try to frighten them, as if getting advice here is a bad thing?!

But TBH what kind of sad individual would ever run or work for a private parking firm?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hey Coupon-Mad

    Thanks for responding.

    So,

I need to respond to BW (ignoring their stupid form) and send SAR to TPS.

And contact DVLA to check when TPS accessed my details.

    Anything else at this stage?

    Thanks

    That should do for now

But ensure you also add in the data rectification notice to tps and to b w legal with your current address, confirming all papers are to be sent there

Because as mentioned above you don't want any to the old address

This is all about procedures and red tape at the moment

    Ignore the financial forms

The financial form is an outrageous bit of fishing isn't it!

I assume the standard letters on the sticky thread will do.

A big part of me doesn't want this hassle and paying them off would be doable but I can't stand how these companies behave. They just want to threaten people into paying and they do not care in the least whether there is any legitimacy to their claim or not.
  • OK.

    New email account created

Request sent to DVLA to find out who accessed my information and when

Response to Letter of Claim sent to BWLegal
    SAR sent to TPS
(both as email attachments, I will post the originals now)

    I'll be back with updates.

TPS Data Protection officer has sent me a (clearly copied and pasted) reply requesting some form of identification in order to respond.
In order to process your request and to verify your identity and accurately locate the information requested, please provide us with a copy of an identification document and the vehicle registration mark. The identification document can be a copy of your driving license, a V5 certificate or similar. Once we are in receipt of this information, we will formally respond to your email within one calendar month from receipt of your identification.

Given that they have my name, address and their reference number, they can clearly identify me. I cannot see any good reason to send them anything and have no intention of giving them more of my personal data.

Is it just me or are they trying to get copies of documents they're not entitled to...

You need to provide a form of ID. We recommend a copy of the V5. All SAR requests meet with a requirement for ID - across all PPCs, nothing unusual.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I don't understand why they need that though. I used the reference number and have sent them copies of their correspondence with my name, the vehicle registration and my address.

    why is that not enough?

I'm not arguing for them, or getting into any debate about the why's or wherefore's.

I presume from your stance on this that you have checked out their entitlement (or otherwise) to seek ID on the ICO website? Why not write back to the PPC and refuse to provide them with any ID, then see if you nevertheless get your SAR information returned.

If you don't, you can lodge a complaint with the ICO. All that might take 2-3 months to resolve. Good luck.

    Thanks.

I'm just asking because I don't understand... According to the ICO guidelines they have to ensure they are giving the information to the correct person but reading through their examples, they have more than enough and their request for further confirmation of ID is unnecessary.

I certainly wouldn't expect anyone here to defend a PPC!:rotfl:

I have indicated my view that they have enough to identify me but if that doesn't work, I'll obviously need to make a decision - getting the SAR info is clearly important...

Thanks again - I am just finding my way through all this.
