So take it up with the ICO, you cannot expect forum members to answer it

We tell people what to do based on experience, knowledge and feedback

So we tell people to use a copy of the V5C or the N1 claim form as proof of ID

The choice on what to do is your to make, but don't expect tps to make it easy for you, their reply was expected if you did not attach the proof and they will cite DPA under the GDPR

    Thanks Redx.

Tone is difficult in on-line forums - I don't mean to come across as argumentative or difficult :o. I hugely appreciate the experience here and am very grateful. I am also impressed that you guys are all prepared to respond and help. It is much appreciated.

My phasing above was a bit strong... should stop trying to do too many things at once! I don't want to give them anything I don't need to!

Having rechecked on the ICO website (The SAR Code of Practice is great), they clearly have enough information to identify me and I have indicated this to them. If not I will use the V5.

    Thanks

I hope at the end of this, I'll have some useful feedback to add.
  • Well, that was easier than I was expected.

Just got the SAR response from TPS:
Thank you for submitting a Data Subject Access Request. Total Parking Solutions Ltd can confirm that we are processing personal data concerning yourself based on the information you have provided, and are happy to provide for you a copy of that data.

But more importantly, further down the email it says this:
Unfortunately due to the age of this notice, we no longer hold images of the vehicle parked at this location. As result, we will request that BW Legal cease with any further recovery processes.

    Thank you guys!

They know they're on a very sticky wicket without evidence, and further confirms that essentially they are using the threat of court action as a lever to raid your wallet. BWL (despite having 'Legal' in their title) are no better than bog standard debt collectors like DRP, Zenith, ZZPS etc.

Well done on forcing a retreat from them. Hang on to that email confirmation.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Oh yes!

I've already forwarded it to BWL, asking them to confirm that they have received this and acted on this.

Thank you all. :T I'll be back if there's any more news.

Don't forget to complain to your MP about this unregulated scam, and the hospital senior management.
You now have proof the claim was without merit and should never have been started so give the hospital a good hammering. It's enough to put you off working there again.

How does a tracing service work? That's not a term I am familar with. I know that debt-collectors are allowed to trace for debts but there is no finding of fact here.

here is a common one we are seeing a lot now

DVLA are very good at confirming when the keeper details were accessed. Arrived by post yesterday.

I was wrong in my suspicion that TPS had re-accessed details but I would still recommend everyone checking as this is an immediate way to stop any claim and is easy and free to do. I know the experienced people here know this but the parking companies are required to make a new application for each claim and to do so within the specified time limits.

Happy to share the wording of the email to DVLA if anyone would like it.

    Subject: Data Protection Request
    Hi,

I have just received a claim for a parking charge from a PPC (relating to an alleged incident from 5 years ago) who have obtained my details as Registered Keeper from the DVLA. I would please like you to confirm exactly when the details for my vehicle **** *** were requested, the organisation or company that requested the details and what the grounds for their request were. I attach the letter that I received on 1st May this year from the PPC addressed to me at the address where the car is registered.

I need the answers to my questions as a matter of urgency as I have now received a Letter of Claim and evidently must respond to this claim by 21st July 2019. In order to deal with this, the information that I have requested from you is necessary for me to decide my grounds for defence. If you do not respond in a timely fashion and I suffer as a consequence I shall take issue with you for the delay.

    Regards

Attached was a scanned copy of the letter from TPS/BWLegal which showed name and address and the vehicle details.

This was based on a version I found online and simply altered to my specific situation.
