House not being removed from market

I know this topic has been covered a few times but not with exactly the same scenario so I still don't have a clear answer.

We put in a full asking price offer on a house after having sold ours (STC) and jumping through the agent's hoop of getting a mortgage arranged with them in-house. When I offered and again when it was then accepted, I stipulated that this was on the condition that the house was taken off the market immediately. That was on Tuesday and it's now Friday, still showing.

We want to get moving and inform our solicitors of the address etc. as well as organising surveys but I'm reluctant to do so until it's showing as Sold STC online.

I've called and emailed the estate agent several times and each time not been able to get them to even agree to it let alone follow it through. They change the subject or ignore my questions.

Without harassing them, how do we proceed? I know it's only been a few days but in my opinion, our offer hasn't been fully accepted until the property is taken off the market.

Should we be looking at back up houses? Or just go ahead with survey etc.? Or wait.....?

    Chicken and egg - if you're not prepared to show you're serious by instructing solicitors/surveyors...

    We have given the estate agent our solicitor's details but they have yet to send a memorandum.

    When you talked to them, what exactly did they want from you to issue the sales memo and take the property off the market?

    They won't take if off the market until you have shown that you are going to proceed by having a survey done. If you don't want this then just withdraw your offer.

    This raises immediate worrys in my mind , it should not be a condition of buying a house that you get the mortgage thru the estate agents.. thats a big no-no as they will profit from that transcation somewhere , and you will be left paying that profit for the next twenty five years

    Are you intending to have a separate survey to that of your mortgage lender?

    Generally EA mortgage advisors are not whole of market, be prepared to not getting the best deal

    They won't say. Whenever I ask about taking off the market, they change the subject or ignore my question. They've said they have all they need for the memo now but just haven't sent it.....

    Mine was taken off the market though at the request of the buyer. Their survey is only happening next week.
    We also lost out on another property because, after our penultimate highest offer, another party bid a higher offer and requested it show as Sold STC. Within a day, the property was shown as such on the web. I doubt they will have managed to meet the criterion of having a survey done so quickly.

    My sister is also buying at the moment and following her offer being accepted 2 weeks ago, the property was shown as SSTC straight away too. Her survey was only this week.

    We were also concerned, we don't need the advice but the estate agent made it quite clear several times that it was necessary for us to proceed. Seems it's fairly common and they have us over a barrel in a way. There was a telegraph article on 'dodgy estate agent tactics' back in 2017 about it.
