    Because they don't ask you if you have had 'any claims' they ask you if you have had 'any accidents or claims' so to say no would be lying and they could potentially use it as a means to not payout when you hit that really expensive car!

    No they couldn't ... any claim that 3rd party might have would still be valid. They wouldn't need to pay out on the insured party's vehicle in such circumstances, and they'd also have the option to sue the insured party for the 3rd party costs, but they couldn't reject the 3rd party's claim.
