PCN for parking on land with cameras - no windscreen ticket but NTK

Hi All

Car whilst being parked on a piece of land which is privately owned. Park Watch have now sent a PCN to my home address, the images (two in total) on the letter shows the car parked next to yellow lines and the images captured show the car in two different locations in their car park which is cut off from the road by double yellow lines. The car was moved forward slightly after 10mins (hence the two locations), in total he must have been parked there for approximately 35-40mins.

The images aren't particularly clear on the letter and the second image just so happens to have the metal cage that covers the CCTV camera right over the number plate.

I have read through the newbies section and I am aware that I need to use the first template in blue to submit my appeal online but my question is that there was a NTK issued to me (incident date: 08/06/2019, NTK received: 17/06/2019) so does the blue template still work for me? There was no pay and display machine to buy a ticket from. The reason they state on the PCN (letter) for the charge is 'No Permit', so I'm assuming it was a car park for permit holders only that was being monitored by CCTV.

Park Watch is a member of the BPA and I can appeal the PCN via email.

The charge is £60 if paid within 14 days or £100 after.

Also, the paint for the car park bays was barely visible and the car wasn't actually parked in a bay but on the edge of the car park almost on the double yellow lines. The PCN does not state from when and to the car was parked there.

Appreciate any help and support with this. Thanks in advance. :o

    just use the blue text appeal and appeal as keeper

    no blabbing about who was driving , so edit your post above

    the DRIVER drove and parked on the day

    the KEEPER received the postal letters including the NTK

    those are the only 2 words required

    in future , stay off private land UNLESS complying with the signage

    I've edited the post as per your suggestion, thanks for that. So I don't need to edit the blue template despite a NTK being served and no available option to pay to park?

    Do you think I have a chance of winning this? Appreciate it will probably have to be appealed via Popla.

    I won't risk even walking on private land after this.

    edit it if you wish , just ensure the driver is not implicated, by appealing as keeper (the person who received the NTK appeals it)

    its impossible to predict a popla result (or a court result) so nobody is going to speculate , but its clear that the driver should not have been there and was foolish to wait on private land being monitored by modern day cameras and so was trespassing

    any win at popla or in court will be on a legal technicality , like no landowner authority , poor and inadequate signage , forbidding signage etc

    I'll give it a try as it is and see what happens.

    Do I submit the appeal to the company now or wait until the last couple of days of the initial 14 day period?

    if you have read the newbies thread you will know that there is no "initial 14 day period"

    the KEEPER has 28 days to appeal the NTK before it "times out"

    the KEEPER can appeal it at anytime within that 28 day window

    the 14 days is irrelevant because its the early bird bribe period

    Apologies, I didn't realise that despite reading it.

    Will get on to it and keep this thread updated with a view that it will help others in this type of situation.

    the 14 days puts pressure on people to pay the full charge minus the 40% discount asap by introducing a quick deadline , so the NEWBIES thread says

    A - FORGET THE '14 DAYS JITTERS'. THE SO-CALLED 'DISCOUNT' IS A BRIBE NOT TO APPEAL - YOU CANNOT DO BOTH

    Thanks, crystal clear but yet I still missed it (silly me!).

    If the appeal isn't upheld when I go through Popla, am I right in saying I'll be liable to pay the higher rate £100?

    you "may" be liable for the £100 , but only if a judge says so, until that happens you do not owe a penny


    only a judge can decide if the keeper owes £100 or not, not popla and not Parkwatch either
