So with the pictures from the link above in y anyone's view is it worth toughing it out and tell them I'm happy to contest in court? The basis of my challenge is that although the vehicle was outside the marked bay the actual markings are ambiguous as a previous marking cut halfway through the bay and is 'hatched'. Therefore the driver could not comply with the 'rule' as if the vehicle had been fully in the bay it would have been on the hatched area and parking on such is also prohibited.This is also an end bay so the overhang did not infringe on an adjacent bay if that makes any difference - EG It's not reducing the capacity of the car park which is what the marked bays are intended to do in the implied contract. I think.0 -
Seen similar defences on here where new markings had been laid over the of of old and therefore were ambiguous.0

So, I lodged the online appeal which although acknowledged was not responded to. They then wrote saying they hadn't had payment and added another 30 quid to it saying if I didn't pay they would take it to Court. I wrote back giving them 14 days to respond to my appeal (which expires shortly).
Should I await their next letter or call them to tell them I have justifiable reason to expect this to be withdrawn (as I explained in the appeal to them) and tell them I am looking forward to presenting my case in Court?0 -
