    Hi again guys, defence is coming together nicely thanks to everyone’s help, just one final thing I need help clearing up - the signs make no mention of keeper liability, only driver liability for a £100 fine. Is it therefore my right not to disclose the details of the driver, and not be held accountable as the keeper, even if the NTK is compliant as per Schedule 4? Many thanks!

    As the keeper, it is your right not to disclose the details of the driver.

    However, if the PPC conforms to the strict requirements of POFA2012, then he can transfer the driver's liability to the keeper.

    The signs do not have to make any mention of keeper liability.

    The signs don't have to mention keeper liability.

    However, it seems from what you've said that the PPC has filed to meet the POFA requirement for 'adequate notice' of the parking charge on signs, given that the sign you showed seems to be miles away and there is no 'private land' entrance sign (or is there?).
