Long story short, we have been properly ripped off by a dodgy kitchen company - wrong bits sent, refusal to refund for bits not sent, awful 'architect' drawing, and us, having to find a professional builder, who was appalled and had to spend weeks getting it sorted as their 'fitters' were mysteriously unavailable - no contact when we asked...and now, after 8 emails and 4 letters, including a pre small claims court letter, they have returned all letters as 'refused'. I know the address is right and they are listed on Companies house, so what do I do now??!! I am determined to see his through as they are ripping off loads of people with seemingly no redress.

Are you sending letters signed for?0

Foolishly we didn't. I am thinking I will send them all back together registered0

Have you googled their address to check it's not their accountant0

So i’m somewhat confused then. You’re sending them to the registered address as per Companies House and they’re being returned? Do they look like they’ve been opened or are they coming back as undeliverable?
I wouldn’t send by recorded. As the onus is on the recipient to prove they didn’t receive the letter, which is a lot easier to do when you use recorded post.0 -
Is it Wren0

Its not Wren no! They have been returned altogether by the Post Office in a PO envelope with 'refused' ticked, but it looks as though they have been opened twice - presumably once by the PO and once by the firm (sellotape on the sticky part) The company registered address on Companies House is the one I am sending to0

I suppose the question I need to ask, is should I go ahead with the Claim? They've had the pre claim letter with 28 days to reply..which was returned.0

What were their last accounts filed? Are they going to have assets to recover?
How did you pay them? You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
If the letters didn't need to be signed for, I'm not sure how they would have been returned?
AIUI, the advice is simply to send first class with proof of posting. There is a legal presumption that first class is delivered two days later, unless the (intended) recipient can show otherwise.0 -

If you've got the right address, and are confident they'll have assets to satisfy a judgement, continue as if they'd received the letters and ignored them.0
