Deleting NHS records

How can I get the GP surgery I am registered with to record my name correctly?
Its not just a spelling mistake, they have my MIDDLE name wrong and I'm told they have an alais written down (totally different name).
I have written to the surgery argued on the phone, and taken ID in?
Lord knows what else they have wrong on my records.
Where do I stand legally?
I feel like suing them, its really upsetting me.
Please help.

Suing them for what? What loss have you suffered?
If you don’t like them as a surgery, register somewhere else.0 -

I got it corrected in the end

They have my details wrong and are inept, they point blank refuse to discuss the matter.
I asked another surgery if I could sign up and they said I'm not in their catchment area.
Why shouldn't I be upset?
Loss? lets try the several hours I've tried to sort this out, lest not forget I cannot collect my prescription because I have erroneous meds on said prescription and I cannot afford to pay for four items when I only need one.
The surgery refuse to give me a paper FP10 - they insist on sending it electronically with things I don't wan't and I don't need and have never been prescribed.
All I want is the Zyloric. I would buy it myself if I could but am not prepared to pay for the full script when it's clearly not mine.
the chemist will not just let me pay one charge for one med.
Now do you under stand why I am upset? This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Not really, no, but let’s look at practical solutions rather than emotional reactions.
Have you contacted the surgery management to put in a formal complaint? That would be my next step, setting out what you want addressed and by when. Your next step would be to contact the local NHS trust complaints team.
If you don’t fancy doing that and are still feeling litigious, itemise and quantify your costs and sue them.0 -

Well, under GDPR:
https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/principles/accuracy/
and
https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/individual-rights/right-to-rectification/
Looking at that, I would firstly ask OP whether:
- They have allowed 1 month for rectification
- There isn't some reason (which an unbiased third party person, like me, would agree with) to allow the refusal of the change.
Aside from that, there may well be scope to report them to the ICO AND lodge a civil claim against them. Though it may be best speaking to a solicitor with regard to that.0 -
Thanks but,
We are at deadlock... they pointblank refuse to discuss the issue...
Have emailed NHS but they said it could take 20 working days. Not got many meds left! This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Sue the surgery and the probability is that they will refuse to treat you and ask you to register with another practiceIf you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

What's the reason for deadlock?
How did you get your meds before?0 -

Can I ask, why are you actually concerned with this issue?
I don't mean it in a horrible way, but I am trying to figure out WHY you don't want your middle name (which is fairly irrelevant in the grand scheme of things) to be wrong. Principle? Or is the "alias" derogatory? etc
You have the right to rectification under GDPR, and in that respect I'm on your side, but if you need those meds to some degree then is that not more important like?
Also, what is their side of things? What are they saying in reply?
EDIT: Apologies, I didn't read your reply properly. I think you have covered it in your reply in post 4.0 -
I don't understand what relevance the middle name issue has to the issue you are actually concerned about, which sounds like a wrong prescription?
You are better off focussing on getting the prescription corrected, rather than going on the war path about your middle name.
Is the prescription something that could be fixed by making an appointment?0
