Have a look at this Pepipoo thread where a useful angle on your case is discussed. http://forums.pepipoo.com/index.php?showtopic=128293
The view so far is the Magistrates don’t have the power to make a civil order regarding Byelaw 14.4.1
Hi, thank you so much for asking after me! I have been getting really stressed about this and tried to seek local advice but I've not had much success. I also kept getting the documents wrong (not redacted properly) so I have focused on redacting them properly and then uploading them into a fresh Dropbox which hopefully does not give away my identity. It's here: https://www.dropbox.com/sh/ihctpv0mr9rwbtk/AAD1n-DIuBBfNrHmSUwI2HGza?dl=0
I hope this is right now!
I have also just posted on Pepipoo so now realise this might be a duplicate, the thread on Pepipoo looks extensive so I will try to comprehend it. It looks like lots of great legal advice was given, I am just not sure if it is sensible to show up on my own. I can learn the points people have made (they look really helpful) but if I get any pushback I will not know what to say. That said, it is better than showing up clueless!
Thank you again.0 -
Ok, good use of time.
Keep checking in here with any developments. We think this is the latest in PPC dirty tricks to get the public to part with their money.
I’m also following on your other thread0 -
By way of updating for anyone interested:
Court case yesterday, with report written over on PePiPoo. Very detailed feedback, however, the issue remains unresolved. They'll be having another go in August. Some interesting stuff raised.
http://forums.pepipoo.com/index.php?showtopic=128403Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I tried to read the court report on ppp and it left me totally confused, (I studied lterature not Law).
AIUI OP tried to pay using an app, (whatever that is), but the payment did not go through and the train company have taken her to Magistrates Court, which may or may not be allowed.
Is this surely not a waste of court time over a few pounds? Has any common sense been applied here? If I was on that bench, these are the sort of questions I would be asking. You never know how far you can go until you go too far.0 -
Its a complete waste of time, of course, but the mag court can hear any complaint
Whats being firstly argued is whether they can pursue any form of civil claim - which this is - at all, and for various reasons why.0
