Blazkowicz, read from post #44 above and you will see that monkeynuts45 produced a Supplementary Witness Statement.
  • Thanks KeithP - It's 'clicked' now! I now understand how Coupon Mad's post #14 from Abuse of Process can be added to a witness statement as a 'Supplementary Witness Statement' exhibit, stating that it adds more recent precedents.

Hahaha, so happy you went to court and reached the high bar, I knew you had it within your grasp in your case:
You seem very close to reaching that bar which is why I typed out a list of things you should mention that tip it over that edge in the Judge's mind.

Your case is rare that the PPC has served a very late WS and then failed to discontinue in time for you to fairly see it and be sure the case hearing is vacated.

You can reasonably conclude that you have little choice but to travel and sit in that waiting room till you see a Judge, armed with your costs schedule but in addition, an argument for ''costs on the indemnity basis to penalise their vexatious conduct and send a message out to parking firms who think they can play fast and loose with the court process and consumer laws.''

    Say that. Try it.

Well done. Kenny Marland's punt at a hundred quid from you has cost him almost five times that! Hopefully that will stick in his throat while trying to chew his turkey tomorrow. :D
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Well the date for payment has come and gone and as yet i have recieved nothing, what is the next steps, i assume i now have to instruct the court to recover the cost for me? What is the correct process, i have read a few things online, just want to make sure i am going in the right track as i believe it is a fee of £25 to instruct the court. Or is ther another path?
