No reason not to. Point out that they knowingly tried to mislead a consumer.

I have got communications from BW Legal asking again for a full copy of my leaseholder agreement. Otherwise they will seek unreasonable costs against me for wasted time. They've got a nerve.
The deadline for proceeding with the court fee passed on 23 October. I haven't received any email nor letters about claim going forward. I have just asked the Court at Reading (they transferred from Leeds to Reading) but their reply time is 10 working days.
The hearing is scheduled for 20 November. I remember that the deadline for sending the Witness Statement is 2 weeks before the hearing, which means 6 November - in just three days. Although a letter from the Court - from August - has a note stating: "Documents filed less than 2 clear days prior to the hearing are not guaranteed to be filed on the Court file.". Has anything changed in this matter?
I remember from the previous case that Witness Statements should be sent to the court and the other party. Which means I should be receiving BW Legal's Witness Statement any day now.
If I ask BW Legal if they are proceeding with the claim are they obliged to respond?

    No they are not obliged

You should make sure that you comply with your court order on submitting your witness statement plus exhibits plus summary costs assessment on time , by email usually , to the court and to the claimant , making sure they go in asap

I wouldn't be worrying about what the claimant is doing to the detriment of your own case

Yes things have changed due to covid , so read the telephone hearings thread by coupon mad.  The one she posted months ago
  • Thank you, Redx. I have found yet another post that helps https://forums.moneysavingexpert.com/discussion/comment/77259162/#Comment_77259162
One could wish there would be an online service to check a status of one's claim. Tried to call the court multiple times but there are no operators available. I doubt they will answer via email before tomorrow. It's a shame that in 2020s such a basic info cannot be established.
I guess I'll have to spend some time and prepare the Witness Statement whether the claim going goes on or was struck out.

If you get the scammers WS first, your priority will be to post it here for the regulars to rip apart so you can add comments to your WS before you need to submit it. Don't miss your WS filing date though.
Even if their WS arrives after you send your, please post it here anyway.
Please only redact YOUR personal data from their WS.

The date to file and serve the WS is NOT two days before.  It is whatever the Order said, and if not, assume no later than 14 days.

The 2 days thing is the electronic copy ready for the hearing, when you also send your phone number.

Did you not respond to this same request back in May when lots of good advice was offered as to what you could have conveyed to them?
