Childs dla delay

Hi my son dla claim runs out in 3 weeks back in February the DWP asked us to submit a new claim with evidence which we did we received a text on the 26 of Feb to say they had received the form and evidence ,Since then we have heard nothing we phone them we keep getting told to try again in two weeks which we do to be told the same thing again . we again phoned today to be told to try again in 3 weeks this time we explained that the claim would have run out by then but was told not to worry as although the payments will stop they will get back dated . we try to explain that they wasn't any good to us as we had bills relating to our son care that still need to be paid and we was told its the nature of the beast and they are very busy . is there anything we can do. Thanks

    Unfortunately, backlogs cause delays and there's no timescales to any decision. Hopefully a decision will be made soon and he'll be successfully awarded. As advised, if a decision isn't made by the end date then you will be backdated any money owed.

    I've been Money Tipped!
    So dose this mean the carers allowance and child tax credit have to be stoped as well. Dose it automatically stop or do I need to phone them both and stop it . I wouldn’t mind but I sent the renewal and evidence within three days of receiving the renewal form there is no delay on my part at all it looks like things are going to get into a right pickle of no fault of ours x

    Carers Allowance is paid for a further 4 weeks then it stops. You will need to let HMRC know if you haven't had the decision by the time the DLA ends, unfortunately the disabled element will also stop.



    As advised, there's really nothing you can do about backlogs.

    I'd be writing to my MP. As:
    a) the DWP should be better resourced / organised;
    b) your MP should know about these problems;
    c) they may be able intervene on your behalf;
    d) the delay will potentially cause you financial (and other) difficulties.
    Alice Holt Forest situated some 4 miles south of Farnham forms the most northerly gateway to the South Downs National Park.

    They should continue to pay DLA until a new decision is made, I would ring to confirm this, but thats what I believe should happen.

    Same as when people transitioned to PIP, until the PIP decision was made, DLA continued to be paid.

    The thing is the man on the phone from dwp told me payment would stop until the renewal was done . I thought the same as you it’s frightening that they will stop all his care money in three weeks even though we Followed their timeline.

    I sure that's not correct. DLA will end if a decision isn't made by the time the end date arrives.

    When transferring from DLA to PIP it's different.

    As I do, I think the existing DLA should continue since it's a DWP delay.

    Add this to your MP's letter and ask them to intervene and confirm with the DWP that it (and CA) will not stop.

    Edit: If it does stop, then I might be inclined to appeal that decision. Since you have complied with your responsibilities, but the DWP have not.

    That’s what I would expect too but I haven't been able to find rules or guidance confirming this.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    Thank you everyone for your replies. I have spoken to the DWP today again i have been told again that the payments will definitely stop in three weeks. Apparently there is huge backlog caused by lots of people awards ending at this time of year the DWP have drafted in extra decision-makers to try and clear this backlog and mine has been placed on an urgent list . The DWP confirmed although They have had my award renewal notice and evidence since February 16 and have complied with the timeline given to me and the error is on their part payments would still stop when my sons award notice runs out. Fingers crossed my sons renewal claim will get looked at before then ,thank you for your help your all-stars xx
