Am I able to claim? Advice needed

  • Thank you for all of your replies, very detailed and have helped a lot.

So where i stand now. I called and e-mailed Ryan Air who say i was not entitled to compensation as i did NOT board the plane and they issued a refund - I contacted back saying i did not ask for a refund and still wish for the compensation to go through.

I e-mailed again and said "to confirm for my records, you will NOT be paying me any compensation of 800 euros due to our delay"

They then replied and said "Yes we will pay 800 euros for your delay but not cover the costs of your food and drink because you have had a refund for your flight, but this does not effect your compensation"...!?

I've emailed back my bank details and they have confirmed i will be paid £682 in the next 10 working days.

After this happened i have read the reply above and maybe should have pushed for re-routing of the flight, but with other issues going on outside of this, i have accepted this as final payment.

800 euro compensation + Flight refund for the flight i didn't take.

Just for anyone else curious or reading at a later date.

    - Flight was delayed 5 hours 20 mins
    - i re-routed myself with Thomas cook so i could get back earlier
(i did NOT board with Ryan Air but bags were checked in and i was checked in)
    - Applied for compensation
    - Had a refund for the flight i didn't take with Ryan Air
    - Had 800 euro compensation for the delay

If anyone believes there is any way i can also claim back the cost of my TC flight then i'd be happy for input, but i believe as i have accepted a refund and compensation, thats the end of the matter, but im happy with the outcome.

    Thanks all again.

No, its not the end of the matter. Compensation and re-routing costs, although both part of regulation 261/2004, are separate issues/articles.
If you have already made a claim for the re-routing costs, that will probably strengthen your claim as RA have made the refund unilaterally.

When I had a problem with easyJet last year I made 2 separate claims as this is how they do it on the website.

I actually made my re-routing costs claim on the day of departure (still had to submit a small claims court papers) but didn't make the compensation claim until I returned 3 weeks later (once I had completely re-read the regulations and established that no EC existed/unreasonable delay for replacement flight). That claim went to CEDR.

I'm not sure about Ryanair, but i suspect there will be 2 different webpages/forms to complete.

I haven't made a claim for the rerouting costs as such, it has been mentioned that i paid for my own flight in my initial email to them.

Would i still be entitled to claim rerouting costs now even though i have received a refund for my flight that i didn't use with Ryan Air?

In theory you can apply for the difference although I doubt you're entited to rerouting costs for the reasons Tyzap mentioned earlier. At this stage I certainly wouldn't do anything until the money promised hits your account!

On this occasion, I disagree with Tyzap. For reasons stated above, I think you are due re-routing costs.

I claimed the difference in re-routing from easyJet after getting a refund. But as i mentioned earlier, I had to take them to court.
