You must complete the Acknowledgement of Service
This gives you 33 days from date of ISSUE to get your defence to them., You will know all this because it is clearly explained, with picutres, on the newbies thread.
You will NOT send a "formal letter" to the CCBC asking the cae to be put on hold, because that will do absolutrley nothing. they will not delay a case just because you ask nicely. THis is a live claim, you are in a formal legal process, and you MUST follow this process0 -
With a Claim Issue Date of 10th May, you have until Wednesday 29th May to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.The date of issue was 10/05/19. Is this still enough time?
Having done the AoS, you have until 4pm on Wednesday 12th June 2019 to file your Defence.
That's nearly three weeks away. Loads of time to produce a perfect Defence, but don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Once you've submitted the AoS as advised by Nosferatu1001 (welcome back), you can go to NEWBIE thread post # 5 and find an explanation for all the acronyms.The date of issue was 10/05/19. Is this still enough time?

Yes thank you all for you help and patience, been reading through far more of the NEWBIES in advance now and think I’m getting my head around it better. Just in the process of my AoS, going to send my emails after, and was going to follow up with a letter to the PPC tomorrow.
Exasperatingly, another question (which I’m sure I know the answer to already but don’t want to get it wrong): NEWBIES states to select ‘defend all of the claim’ on the AoS. Would this still be the case when my gripe has been not receiving previous letters or any earlier chance to pay/appeal? Would that then not make it ‘defend part of the claim’?0 -

Well they have photos of my car that was parked there too long. The signs there are bland but not hidden after I checked them again, but I didn’t get a PCN through my door until 2months after the incident so I didn’t know if the sign had just been misread before or if they’d changed the signs since.
I was just given no earlier chance to pay, or was even aware I’d be receiving a penalty. Surely I can’t defend my car being parked there when there’s photographs

Have you not read any Defences yet?
Were the signs capable of forming the basis of a contract with the driver?
Does the Claimant have the authority of the land owner to sue people?
Anyway, which part of the claim do you want to defend?
Do you think the Claimant will be happy to accept part of the monies they allege due?
You seem to be missing one big point: These car park companies are only in it for the money. They don't care how they get it. They will not accept anything less than they currently demand once they see a Defendant wavering.

You need to understand you will defend the WHOLE claim.
We win 99% of the time and EVERY thread has signs and photos of a contravention.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
