Private PCN with no first letter, now County Court Business Centre claim
Sboo
I posted on here a while ago because I received a private PCN by post as my car was parked too long, but I did not receive a first letter and the second letter only arrived when/after the third did so I just had a a letter for £160 - 100 with 60s fees on top. My argument was that I’d be given no equal chance to pay the original fine or with a discount, nor was I given the right to appeal as I was too late. Advice on here told me to appeal by letter to the company address with recorded delivery, which I did, but received no other response until now.
I’ve now received a letter from County Court Business Centre.
It’s a pretty hefty note. It has in it a section of admission, which how much to the claim you admit. Should I put here the initial amount for fine (can’t remember they’re actual term) since my dispute was that I hadn’t been given right to pay an earlier fine and they’ve offered no proof of sending the letter. I should add that when I spoke to them the guy on the phone said the only chance I’d get to appeal any of it/give a chance to pay without the added fees would be to prove I never received the letter...the only proof I have is that I’ve never physically had the letter and they’ve offered nothing to suggest otherwise!
Help!

Is this a claim form? Did you receive a Letter Before Claim? I was going to ask if you have moved recently, which might explain not receiving letters BUT you did receive the court papers. You should log in to MCOL and carry out an Acceptance of Service (AoS). You want to defend in full (assuming you do) but put nothing, not even a full stop, in the defence box. You will send your defence by e-mail later. You might have to apply for a Government Gateway log-in and password.0

It is a claim form, yes. I didn’t receive a letter since posting my appeal. The last letter I received was the letter with the extra £60 fees. On the Admission section of this letter it has a tick box for How much of the claim you wish to admit, options being I admit to the full amount, or I admit to the amount of...
So would I find out the initial amount and write it in here, and then not fill in the rest?
I guess for my defence I would just need any previous PCN letters, my appeal letter, and proof of posting. Would there be anything else that could help me?0 -
You need to go to the NEWBIE section post # 2 and read up about claim forms. What is the issue date of your claim form from Northampton?0

I posted on here a while ago ...
Why have you opened another thread? Can you please merge them.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
I’m sorry, I hadn’t read the NEWBIES 2 - should I just try and delete my previous post, or how do I merge?
The Claim Form has 14days to reply...tomorrow will be my last day! I know I’ve cut it ridiculously fine, no other excuse than I’ve been fretting about it. So the gist I’m now getting is that I should email PPC with a SAR, and send a formal letter to CCBC stating I’ve requested a SAR and ask the case be put ‘on hold’...would I then not send them any of the claim form back, or simply sign it and send that part and none of the other information?
I’ve just realised in trying to find the rest of my paperwork I cannot find the originals of the PCN letters, but I do have full copies of them as I sent photos of them to Dad for advice, and I do still have the copy of my posted appeal, with post office receipt, and screenshot of their signature/receipt of delivery. Will this cause a problem?0 -
Oh I just reread another part of the letter that states the day of service is taken as 5days after issue so I’ll have 5 more days from tomorrow0

1. To merge threads, send a PM to a board guide (Crabman, Savvy or Soolin) and ask one of them to merge your threads.
2. You cannot send anything to CCBC asking for the process to be put on hold, that is something you should have sent to the PPC after receiving the LBC.
3. You are sending (or have sent) a SAR to the PPC precisely to get copies of EVERYTHING that has been issued to you including the original PCNs
4. You should complete the AoS on-line via MCOL, which will buy you some more time to construct and submit your defence.
5. Urgent reading of the NEWBIE section post # 2 is required.0 -
You are not filling in paper forms, nor admitting ANY of the scam claim. On the Admission section of this letter it has a tick box for How much of the claim you wish to admit, options being I admit to the full amount, or I admit to the amount of...

What is the issue date of your claim form from Northampton?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The date of issue was 10/05/19. Is this still enough time?
I had read over the newbies #2 but maybe I was getting confused with the acronyms.0
