    Costs on the 'indemnity' basis like Justica's £700+ can be argued for at the hearing but it's a high bar to meet, hence the link to Justica's example.

    Hello,

    I have just received my notice of allocation to the small claims track. It mentions that the claimant needs to pay the court trial fee by a certain date or file a properly completed application form.

    Is this normal? Does this mean VCS hasn’t done something correctly?

    Can I now submit my witness statement following the Newbie thread? My hearing isn’t for a fair few months, can I send my witness statement now?

    Quite probably.
    Can I now submit my witness statement following the Newbie thread? My hearing isn’t for a fair few months, can I send my witness statement now?
    You will receive a Directions Questionnaire from the court which will give you a deadline by when to submit your WS (normally 14 days prior to the hearing date).

    As with all court cases, you are pointed towards the NEWBIES FAQ sticky, post #2 which provides all the answers to all your questions about the court process from start to the actual hearing.

    The letter I have received mentions directions from the judge including witness statements but doesn’t ask questions. Explains what will happen at the heating and tells me about what the witness Statement must include etc

    It also mentions, unless I apply for help with fees there will be no more correspondence from the court regarding payment of fee or any further warnings.

    What shall I do now? Just wait to receive further notifications?

    I have also changed address, how do I get this updated?

    Sorry if these questions seem stupid.

    I have read many threads and everyone’s so helpful, all I want is some advice. If you don’t want to help please just ignore my thread.

    No I have t called the courts because as I previously mentioned, I only received the letter today.

    Yes I have researched but haven’t found anything hence why I have put it on my thread.

    You have just mentioned a directions questionnaire, what I have received doesn’t look like one of those but mentions the directions of a judge.

    I struggle with things like this, hence why i am turning to the forum for help.

    Please don’t reply with something to make me feel stupid, I’ve done anything like this before and I want to get it right.

    So you have the normal next stage letter, the one you should be expecting, from your local court? As explained by bargepole in his COURT PROCEDURES thread, linked in the NEWBIES thread post #2...what's not clear from his advice there?

    Re the new address you will need to mention it in your WS & evidence but FIRST, now email the DPO of the PPC and their solicitors and require that they 'rectify the date held for your address for service'.

    The NEWBIES thread also tells everyone how to find the DPO email addy of any PPC.

    Send an e-mail to the Data Protection Officer (DPO) of the Private Parking Company (PPC) - all acronyms are available in the NEWBIE sticky post #5 in order to rectify the data held about you, specifically the address for service, as presumably they have it recorded incorrectly. Witness Statement (WS) is just you unless you are relying on someone else to give evidence, in which case they need to provide a WS and appear in court with you.
