I think so.  For the courts point of view ...... you tried
Much cheaper for VCS to discontinue than face your costs when you win

Replace "To whom it may concern" with "Dear Sirs".
..... and finish with Yours faithfully

Why on earth do you wish to give the scammer a get out of jail card?

    What are the other options?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Afternoon All,
I sent VCS Litigation the Drop Hands email stating they have up to 7 days to agree but havent heard anything back - totally appreciate the situation, any recommendations of what I do next?
Is it down to me to write to the courts and request a hearing?
    Many thanks
